A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
GRANTING APPROVAL OF TENTATIVE TRACT NO. 44089.
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find and determine that an
application was duly filed by Gary Almas, with respect to the real property
located at 8247 -53 Gardendale Street, requesting to subdivide a 9360 plus
or minus square foot parcel into five (5) lots in an R -2 zone; that
public hearings were duly set for June 11 and June 25, 1985 at 7:30 p.m.,
in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue,
Downey, California, and a notice of the date, time, place and purpose of
aforesaid hearings were duly given; that hearings were held at the
aforementioned time and place.
SECTION 2. The City Council further finds and determines that all
requirements set forth in Section 9200 have been completed to justify
the granting of the Tentative Tract Map.
SECTION 3. Based upon the aforementioned findings the City Council
hereby grants approval of Tentative Tract No. 44089, subject to the
following conditions:
PLANNING
1. This approval is for a five lot planned unit development
residential subdivision comprised of four single family detached
dwellings and one common lot as shown on the approved plan
dated April 1, 1985. Deviations or exceptions from said plan
shall not be permitted without the approval of the City Planning
—. Commission.
2. The Planning Commission shall retain jurisdiction to amend or
add conditions without further public notice or hearing to assure
compatibility with the purpose and intent of the Comprehensive
Zoning Ordinance and to protect the public health, safety and
general welfare.
3. This approval shall be contingent upon the approval of Zone
Variance #384, and all conditions of Zone Variance #339 shall
remain in full force and effect.
4. A final tract map shall be approved by the Planning Commission
and City Council prior to a building permit being issued.
5. Approval by the Design Review Board for colors, materials,
landscaping /irrigation plans, and building architecture is
required prior to the issuance of building permits.
6. Parking, driveway and landscaping areas shall be constructed
and permanently maintained in conformance with Sections 9150
and 9152 of the Downey Municipal Code.
7. A copy of required Conditions, Covenants and Restrictions
(C.C.R.'s) shall be submitted to the Planning Division.
8. If City approval is contingent on any changes to the plans
as submitted, the applicant shall submit three copies of revised
plans, incorporating all approved amendments, overlays,
modifications, etc. to the Planning Division prior to the issuance
of buildings permits.
ENGINEERING
9. The existing curb depresssions shall be replaced with curb
only to the standards of the City Engineering Division.

10. The alley adjacent to the subject property shall be improved
to the standards: of the Department of Public Works.
11. Full parkway width sidewalk, handicapped ramp and parkway
trees shall be installed along Downey Avenue and Gardendale Street.
Said improvement shall be permanently maintained to the standards
of the Department of Public Works and the City Engineering Division.
12. An engineered grading plan for the, tract shall be submitted
by the developers for approval by the Engineering Division and
Building and Safety Division, and the tract shall drain to a
alley or street and have not less than a 1% grade, and whenever
the grade differential exceeds one foot, a retaining wall shall be
required.
13. The standards of improvement, construction materials, and
methods of construction shall be accomplished in conformance with
the standard plans and specifications as outlined by the City of
Downey.
14. All necessary drainage structures and street grading plans
shall be approved by Engineering Division.
BUILDING AND SAFETY
15. Separate sewers shall be constructed to each home to the
standards of the City Engineering Division and Building and
Safety Division or a sewer covenant shall be recorded with the
Los Angeles County Recorder's office, and a copy filed with
the City Planning Division.
16. All electrical and telephone utilities shall be installed
underground or at the rear lot lines to the standards of
the Engineering Division and Building and Safety Division.
17. The applicant shall provide an easement for sewer access as
required by the City's Division of Building and Safety.
SECTION 4. The Tentative Tract approval is conditional upon the
privileges being utilized within two (2) years after the effective date
thereof, and if they are not utilized or construction work is not begun
within said time and carried diligently in accordance with conditions
imposed by the City Council, this authorization shall become void, and
any privilege, permit or variance hereby shall be deemed to have elapsed.
SECTION 5. That the environmental impact of the proposed project
has been reviewed and is hereby certified to be in compliance with the
California Environmental Quality Act (CEQA) and the City's Guidelines.
SECTION 6. The City Clerk shall certify to the adoption of this Resolution
and shall transmit a copy to the Applicant, Planning Division, Building and
Safety Division, and City Engineering Division.
