HomeMy WebLinkAboutResolution No. 4532 RESOLUTION NO. 4532 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RELATING TO ITS CABLE TELEVISION FRANCHISE - THE CITY COUNCIL OF THE CITY OF DOWNEY DOES FIND, DETERMINE AND DECLARE AS FOLLOWS: 1. The City finds that consistent with Section 7.1 of Ordinance No. 679 as amended by Ordinance No. 785 , Rogers Cablesystems, Inc. has substantially completed construction of its system to the satisfaction of the City and, pursuant to Section 5.5 of Ordinance No. 679, is hereby authorized to reduce its faithful performance bond to the sum of $60,000. 2. If Rogers makes progress in improving its financial condition, including substantially increasing the number of cable subscribers it serves in the City, the City will consider in December 1985 granting Rogers a five -year extension of its present franchise. 3. Amendments to Ordinance No. 679 as set forth in Ordinance No. 785 shall become effective only upon the execution of an acceptance by Rogers which requires Rogers to agree to the repeal of such amendments as a precondition to the assignment of the Cable Television Franchise. Said acceptance shall further provide that Rogers will not contend in any judicial or administrative proceeding that the Cable Television Franchise is not a grandfathered franchise within the meaning of the Federal "Cable Communi- cations Policy Act of 1984." Rogers shall also provide the City with a copy of its 1984 audited financial statements as a condition of its acceptance. APPROVED AND ADOPTED THIS 26th day of February 1985.
