HomeMy WebLinkAboutResolution No. 4416 RESOLUTION NO.4416 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY MAKING CERTAIN DETERMINATIONS RELATING TO CEQA COMPLIANCE IN CONNECTION WITH THE APPROVAL OF A DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF DOWNEY AND SHEPHERD DEVELOPMENT WHEREAS, the Community Development Commission of the City of Downey ( "Commission ") is responsible for implementing the Redevelopment Plan for the Project Area of the Downey Redevelopment Project, as amended (the "Redevelopment Plan "); and WHEREAS, the Commission desires to enter into that certain Disposition and Development Agreement with Shepherd Development, a California joint venture (the "Developer ") pursuant to which the Developer shall develop certain office and parking facilities (the "Project "); and WHEREAS, the City Council has previously caused to be certified an environmental impact report ( "EIR ") for the Redevelopment Plan and for amendments thereto; and WHEREAS, Section 15180 of the State EIR guidelines (California Administrative Code Title 14, Division 6) provides that all public and private undertakings pursuant to or in furtherance of a redevelopment plan constitute a single project, which shall be deemed approved at the time of adoption of the Redevelopment Plan; and WHEREAS, the proposed Disposition and Development Agreement does not encompass changes in the Redevelopment Plan that would necessitate an additional EIR or supplement to an EIR, nor have circumstances changed such that an additional EIR or supplment is required; NOW, THEREFORE, the City Council of the City of Downey does hereby find, determine and resolve as follows: Section 1: Having reviewed the proposed Disposition and Development Agreement and being familiar with the EIR for the Downey Redevelopment Project, the City Council hereby finds and determines that (i) the proposed Disposition and Development Agreement does not encompass changes in the Redevelopment Plan that would necessitate an additional EIR or supplement to an EIR, (ii) circumstances have not changed such that an additional EIR or supplement to an EIR is required, and (iii) no additional EIR or supplement to EIR is required by virtue of the Disposition and Development Agreement. Resolution No. 4416 Section 2: City staff is hereby authorized and directed to file a Notice of Determination with the County Clerk of the "' County of Los Angeles.
