A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY TO PLACE THE CITY OF DOWNEY IN
COMPLIANCE WITH THE FEDERAL AGE DISCRIMINATION
IN EMPLOYMENT ACT OF 1967 AS AMENDED.
WHEREAS, the City Council of the City of Downey does not wish to be
in violation of The Age Discrimination in Employment Act of 1967, as amended;
and
WHEREAS, the City of Downey is required to follow the rules promulgated
by the State of California for the Public Employees' Retirement System; and
WHEREAS, the rules of the State of California Public Employees' Retirement
System regarding mandatory retirement of employees in safety member classifi-
cations are in conflict with The Age Discrimination in Employment Act of 1967,
as amended.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the City of Downey will not violate the provisions of
The Age Discrimination in Employment Act of 1967, as amended, and that no
employee in a safety member classification will be mandatorily retired before
age seventy (70) for reasons other than medically related disability.
SECTION 2. That nothing in this resolution is intended to preclude an
employee in a safety member classification from being mandatorily retired on
the basis of physical or mental incapacity to perform the duties of his or her
position.
SECTION 3. The City Clerk.shall certify to the "adoption of this
resolut .n and shall provide for appropriate distribution thereof.
APPROVED AND ADOPTED this 12th day of June, 1 84.

I HEREBY CERTIFY that the foregoing resolution was duly adopted by the
City Council of the City of Downey at a regular meeting thereof held on the
12th day of June , 1984, by the following vote, to wit:
