A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY ADOPTING AMENDED
GUIDELINES FOR THE IMPLEMENTATION OF
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

WHEREAS, at a meeting held October 5, 1983, the Planning Commission considered pro-
posed amended guidelines for the implementation of the California Environmental
Quality Act (CEQA), and by Planning Commission Resolution No.. 693 recommended to
the City Council that the State CEQA Guidelines be adopted by reference with im-
plementing procedures as specified in said Resolution; and
WHEREAS, said amendment is necessary for compliance with State law and the promotion
of environmental quality in the City of Downey; and
WHEREAS, it has been determined that said amendment could not have a significant
adverse effect on the environment and is therefore exempt from the California
Environmental Quality Act; and
WHEREAS, the State CEQA Guidelines provide that local governments may adopt said
Guidelines by reference provided that implementing procedures are specified.
NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby adopt by reference
the State CEQA Guidelines with the following implementing procedures:
(1) The following responsibilities are delegated to City Staff:
(a) Determining the activities that are exempt from CEQA.
(b) Conducting initial studies of environmental impact.
(c) Preparing Negative Declarations.
(d) Preparing draft and final Environmental Impact Reports (EIR's)
or contracting for the preparation of EIR's as described in
the "Procedures for Contracting with Environmental Consultants"
(Exhibit A) .
(e) Establishing and maintaining a list of eligible environmental
consultants.
(f) Consulting with and obtaining comments from other public agencies
and the public in regards to environmental issues.
(g) Assuring that time periods for performing under CEQA are complied
with and that adequate public review of environmental documents
is afforded.
(h) Evaluating and responding to comments received on environmental
documents.
(i) Commenting on environmental documents received from other agencies.
(j) Filing documents required or authorized by CEQA and the State CEQA
Guidelines.
(k) Updating the City's environmental guidelines in response to State
legislation and amendments to state guidelines.
(2) The decision - making body reserves the following responsibilities:
(a) Reviewing and considering a final EIR or approving a Negative
Declaration prior to approving a project.
(b) Making findings in regards to significant environmental impacts
identified in an EIR for a project prior to approving the project.
(c) Making a Statement of Overriding Considerations for projects
approved in spite of unavoidable adverse environmental effects.
