HomeMy WebLinkAboutResolution No. 4245 RESOLUTION NO. 4245 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OPPOSING CALIFORNIA STATE SENATE BILL 965 WHICH WOULD ELIMINATE EXPANSION OF EXISTING SOLID WASTE MANAGEMENT FACILITIES OR CONTROLLED SITING OF NEW FACILITIES WHEREAS, the City of Downey is committed to the support of environmentally sound and cost effective solid waste management facili- ties in Los Angeles County, including transfer stations, refuse -to- energy facilities, and landfills; and WHEREAS, California State Senate Bill 965 has been introduced in the California State Senate which would eliminate the expansion of existing solid waste management facilities or siting of new facilities and could jeopardize the continued operation of existing solid waste management facilities in Los Angeles County within one mile of a resi- dential structure, regardless of environmental control and documentation or economic consequences; and WHEREAS, the siting of solid waste facilities is a matter appro- priate to local control, so lone as that control is required to be exer- cised in an environmentally sound and responsible manner; and WHEREAS, the Senate Bill 965 is unnecessary in that existing State law, Section 66784.1 of the Government Code, requires that the County in which a facility is located make a finding that "....the distance of residents from the site is sufficient to permit adequate control of noise levels, odor nuisances, traffic congestion, litter nuisances and vectors "; and WHEREAS, the potential fiscal impact of Senate Rill 965 is excessive anti could exceed $1.5 billion per year as a direct result of long distance haul to remote areas of Los Angeles County. NOl!, THEREFORE, be it resolved by the City of Downey, as follows: (1) that the City does hereby express its total opposition to California Senate Bill 965. (2). That a copy of this resolution be forwarded to Governor George Dukemejian, Lt. Governor Leo T. McCarthy, Controller Kenneth Cory, Treasurey Jess M. Unruh, Members of the Senate Finance Committee, and other Members of the California Legislative. APPROVED AND ADOPTED THIS 24th day of May, 1983. i �� fi / James T.
