A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF
A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON
TUESDAY, JULY 19, 1983, FOR THE SUBMISSION TO THE QUALIFIED
ELECTORS OF SAID CITY AN ORDINANCE RELATING TO A LONG TERM
LEASE AND APPROVING A SETTLEMENT AGREEMENT AND MUTUAL
RELEASE BETWEEN THE CITY OF DOWNEY AND THE DOWNEY COMMUNITY
HOSPITAL FOUNDATION
WHEREAS, the City Council of the City of Downey did on February 8, 1983,
duly adopt Ordinance No. 711 providing for a Long Term Lease and approving a
Settlement Agreement and Mutual Release between the City of Downey and the
Downey Community Hospital Foundation; and
WHEREAS, the said Ordinance was duly published as required by law; and
WHEREAS, pursuant to authority provided by City of Downey Charter Section
1303, a petition has been filed with the legislative body of said City signed
by more than ten percent of the number of qualified registered voters of said
City protesting the adoption of the hereinabove Ordinance referred to; and
WHEREAS, the City Clerk of said City has duly examined and from the
records of registration ascertained that the petition is signed by the
requisite number of voters and has so certified; and
WHEREAS, the City Council of said City has not voted in favor of the
repeal of the Ordinance; and
WHEREAS, the City Council of said City is thereupon authorized and
directed by City Charter Section 1303 to submit the Ordinance to the qualified
voters; and
WHEREAS, the Downey City Council, at its regular meeting of April 12, 1983,
did declare and call for a Special Election to take place on July 19, 1983, for
the purpose of submitting the Ordinance to the qualified voters.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to the provisions of City of Downey Charter
Section 1303, there is hereby confirmed called and ordered held in the City of
Downey, County of Los Angeles, State of California, on Tuesday, July 19, 1983,
a Special Election of the qualified electors of said City for the purpose of
submitting the following proposed question, to wit:
: Shall Ordinance No. 711 approving a Long Term YES
: Lease and approving a Settlement Agreement and
Mutual Release be adopted . NO .
A cross ( +) placed in the voting square after the word "YES" hereinbefore
provided shall be counted in favor of the adoption of the question. A cross
( +) placed in the voting square after the word "NO" in the manner hereinbefore
provided shall be counted against the adoption of the question.
SECTION 2. That pursuant to Article 4, Chapter 3, Division 5 of the
Elections Code of the State of California, the legislative body of said City,
or any member or members thereof authorized by such body, or any individual
voter or bona fide association of citizens, or any combination of such voters
and associations, may file a written argument, not to exceed 300 words in
length, for or against said City Ordinance.
SECTION 3. That based upon the time reasonably necessary to prepare and
print the arguments and sample ballots for said election, the City Clerk hereby
sets May 9, 1983, as a reasonable date prior to such election after which no
arguments for or against said City Ordinance may be submitted for printing and
distribution to the voters as provided in said Article 4. Arguments shall be
submitted to the City Clerk at the City Hall, Downey, California. An argument

shall not be accepted under this article unless accompanied by the name or
names of the persons submitting it, or, if submitted on behalf of an organiza-
tion, the name of the organization and the name of at least one of its
principal officers. No more than five signatures shall appear with any
argument submitted under this article. Arguments may be changed or withdrawn
until and including said date fixed by the City Clerk.
SECTION 4. That the City Clerk of said City is hereby authorized,
instructed and directed to procure and furnish any printed manner, official
notices, publications, etc., that may be necessary in order to properly and
lawfully conduct said election.
SECTION 5. That the polls for said election shall be open at 7 :00 a.m. of
the day of said election and shall remain open continuously from said time until
7:00 p.m. of the same day when said polls shall be closed, except as provided in
Section 14301 of the Elections Code of the State of California.
SECTION 6. That in all particulars not recited in this Resolution, said
election shall be held and conducted as provided by law for holding municipal
elections in said City.
SECTION 7. That all ballots for said election will be counted at a central
counting place, said counting place shall be designated as the Downey Community
Theatre, 8450 Second Street, Downey, California.
SECTION 8. That notice of the time and place of holding said election is
hereby given and the City Clerk is hereby authorized, instructed and directed to
give such further or additional notice of said election in time, form and manner
as required by law.
SECTION 9. That the City Clerk shall certify to the passage and adoption
of this Resolution; shall enter the same in the book of original Resolutions of
said City; and shall make an entry of the passage and adoption thereof in the
records of the proceedings of the City Council of said City in the minutes of
the meeting at which the same is passed and adopted.
