HomeMy WebLinkAboutResolution No. 4195 RESOLUTION NO. 4195 A RESOLUTION OF THE CITY COUNJCIL OF THE CITY OF DOWNEY, GRANTING ZONE VARIANCE NO. 241. The City Council of the City of Downey does resolve as follows: SECTION 1. The City Council does hereby find and determine that an application was duly filed by Dr. Stanley Cohen with respect to the real property described as follows: 8605 Firestone Boulevard requesting a Variance to permit i additional signing which exceeds the requirements of the City Code, for the purpose of directing pedestrian traffic; that a public hearing was duly set for January 11, 1983 at 7:30 p. m. , in the Council Chamber of the Downey City Hal l , 8425 East Second Street, Downey, California, and a notice of the date, time, place and purpose of aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. Studies and investigation made by the City Council and in its behalf reveal the following facts: (1) Special conditions and circumstances exist which are peculiar to the land involved which are not generally applicable tocther lands in the same vicinity and zone since vehicular circulation and off - street parking areas were established in such a spanner that minimum signage of 3.5 square foot for directing pedestrian traffic for public safety is viewed as being warranted. (2) Literal interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the City under the terms of the Zoning Ordinance, since similar size signage has been granted to other commercial establishments along Firestone Boulevard. (3) Special conditions and circumstances do not result from actions of the applicant since said commercial structure and corresponding vehicular circulation and off - street parking design were established under a code which was less restrictive. (4) Approval of the variance will not confer a special privilege that is denied by the Zoning Ordinance to other lands. (5) Granting approval of the applicant's request will not adversely affect the Comprehensive General Plan. (6) That the environmental impact of the proposed request has been reviewed and has been certified to be in com- pliance with the California Environmental Quality Act (C.E.Q,A.) and the City's guidelines, and said project is Class 1, Categorically exempt. SECTION 2. The City Council further finds and determines that facts exist as required in Section 9164.18 of the Downey Municipal Code justifying the granting of a Variance. t - -_ SECTION 3. Based upon the aforementioned findings, the City Council hereby grants with respect to the property described in Section 1, above, a Variance subject to the following conditions: 1. This approval is for the addition of one (1) square foot of signing to be added to the 2 -1/2' square feet of signing on the rear door of the subject building, which shall be 4" in height enclosed by an arrow to read: "Entrance in Front" and the two existing painted signs reflecting 4 square feet and 7 square feet res- pectively shall be removed, as shown on the revised plot plan dated December 3, 1982. Deviations or exceptions from said plot plan and elevation shall not be permitted without the approval of the City Planning Commission. Resolution No. 4195 Zone Variance #241 Page 2 2. An agreement shall be executed by the property owner and filed with the City Engineering Division for the future installation of street lights on Firestone Boule- vard, to the standards of the City Engineering Division. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and shall transmit a copy to the applicant, Building and Safety Division, City Engineering Division and City Planning Division.
