HomeMy WebLinkAboutResolution No. 4100 RESOLUTION NO. 4100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, RESCINDING AND DECLARING VOID RESOLUTION NO. 4046 RELATING TO THE DOWNEY COMMUNITY HOSPITAL FOUNDATION LEASE. WHEREAS, the public health, safety and general welfare of the City of Downey requires that the Downey Community Hospital must continue to be operated as a municipal hospital consistent with a public trust created by a vote of the electors establishing a municipal hospital; and WHEREAS, the City Council has consulted with legal counsel regarding the validity of Resolution No. 4046 and the existence of grounds for rescinding said Resolution and declaring the same void and of no further operative affect; and WHEREAS, the City Council has been advised by legal counsel that grounds exist for rescission of said Resolution No. 4046 and the amendment to lease and grant of reversionary interest thereunder. THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the public health, safety and general welfare of the City of Downey requires that the Downey Community Hospital must continue to be operated as a municipal hospital consistent with a public trust created by a vote of the electors establishing a municipal hospital. SECTION 2. That the certain Resolution No. 4046 adopted by the City Council on November 24, 1981, together with the attached Addendum to the lease and grant of reversionary interest are hereby declared to be void and of no further operative effect and the same are rescinded. RESOLUTION NO. 4100 SECTION 3. That the City Clerk of this City is hereby directed to enter this Resolution in the minutes of the City Council.
