HomeMy WebLinkAboutResolution No. 4071 RESOLUTION NO. 4071 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES. (ANNEXATION 82/2 - STOAKES AVENUE BETWEEN GALLATIN ROAD AND VISTA DEL RIO DRIVE. WHEREAS, the City Council by Resolution No.4069 proposed to annex a certain area into the Lighting Maintenance District AD 121 pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Part 2 of Division 15 of the California Streets and Highways Code); and WHEREAS, by said Resolution No.4069 , the City Council ordered the City Traffic Engineer to prepare a report pursuant to Article 2 of Chapter 1 of Part 2 of Division 15 of the California Streets and Highways Code; and WHEREAS, the City Traffic Engineer did prepare and file such a report and such was approved by the City Council on the 9th day of February, 1982, by Resolution No. 4070. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Downey to order the annexation of a certain area into the Lighting Maintenance District AD 121, and to maintain and furnish electrical current to street lighting fixtures located on Stoakes Avenue between Gallatin Road and Vista Del Rio Drive in the City of Downey as shown on Plan No. SL -82/2 on file in the office of the City Clerk, in accordance with the report of the City Traffic Engineer dated February 9, 1982, also on file in the office of the City Clerk and which by this reference is made a part hereof. - - SECTION 2. This annexation, in the opinion of the City Council, is of more than ordinary benefit, and the Council hereby makes the costs of all expenses, work, improvements, energy and maintenance chargeable upon the zone within the District benefitted. The area within the District is that portion of the City of Downey shown on the above specified plan on which the boundaries thereof are described by boundary line. Reference is hereby made to the plan for a complete and detailed description of the area. The plan on file shall govern for all details as to the extent of the assessment. SECTION 3. Any lots or parcels of land known as public property, which are included in the District, shall be exempt from assessment in accordance with Section 22663 of the California Streets and Highways Code. SECTION 4. The improvements contemplated shall be done under the provisions of Chapter 6 of Part 2 of Division 15 of the California Streets and Highways Code (Section 22675 et seq). SECTION 5. Collection of assessments caused by this resolution shall be made pursuant to the method described by Article 2 of Chapter 4 of Part 2 of Division 15 of the California Streets and Highways Code (Section 22645 et seq). SECTION 6. Notice is hereby given that on February 23, 1982, at 7 :30 p.m. in the Council Chambers of the City of Downey at 8426 Third Street, Downey, California, all interested persons may appear before the City Council and be heard concerning annexation into the District and all other matters relating thereto. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Any such protest shall state all grounds of the objection and shall contain a description sufficient to identify the property. SECTION 7, The City Clerk shall cause notice of the hearing to be given pursuant to Article 2 of Chapter 2 of Part 2 of Division 15 of the California Streets and Highways Code (Section 22550 et seq), SECTION 8. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this 9th day of February , 1982, ATTEST:. Milton R.
