HomeMy WebLinkAboutResolution No. 4054 RESOLUTION NO. 4054 A RESOLUTION OF THE COUNCIL OF THE CITY OF DOWNEY SUPPORTING THE RECENT SUPERIOR COURT DECISION, CITY OF LOS ANGELES VS. THE COUNTY OF LOS ANGELES, AND ENCOURAGING THE COUNTY BOARD OF SUPERVISORS TO IMPLEMENT THIS JUDGMENT IN AN EXPEDITIOUS MANNER WHEREAS, the City of Downey is a member in good standing of the Independent Cities Association of Los Angeles County; and WHEREAS, the primary goal of the Independent Cities Association of Los Angeles County is to promote tax equity between the cities of Los Angeles County and the County of Los Angeles; and WHEREAS, the City of Los Angeles brought suit against the County of Los Angeles which resulted in a judgment prohibiting the practice of Los Angeles County providing only certain services and benefits on an uniform county -wide basis while providing other municipal -type services only on a non - uniform basis to unincorporated areas without charge and financing both types of services by the use of property tax revenues; and WHEREAS, the Court found that the noted practice contravenes the equal protection clause of the Federal Constitution and Article 1, Section 7, and Article 4, Section 16, of the California Constitution, as the practice relates to financing of the non- uniform services in the unincorporated areas; and WHEREAS, the Court decreed that Los Angeles County is permanently enjoined from financing the providing of non- uniform services such as Sheriff's patrol and station detectives, County Engineer, Parks and Recreation, Regional Planning, Animal Control, and Forester and Fire Warden structural fire protection to the unincorporated areas of the County of Los Angeles through the use of property tax revenues which are generated uniformly throughout the County. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Downey: SECTION 1. It hereby urges the Los Angeles County Board of Supervisors to implement the provisions of the heretofore noted judgment in the most expeditious manner possible to return a measure of tax equity between cities and unincorporated areas. SECTION 2. The City Clerk shall certify to the adoption of this reso- lution and thenceforth and thereafter the same shall be in full force and effect.
