RESOLUTION NO. 4044
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ALLOWING CALIFORNIA CABLESYSTEMS TQ INSTALL THEIR TRUNK
LINE THROUGH THE CITY OF DOWNEY ON TERNS AND CONDITIONS
SPECIFIED BY THE CITY.
WHEREAS, California Cablesystems has cable television franchi
to service Paramount, Bell Gardens and Santa Fe Springs; and
WHEREAS, California Cablesystems must install their trunk line
through the City of Downey in order to serve the areas currently under
franchise to California Cablesystems; and
WHEREAS, the City of Downey is willing to allow the installation of
this trunk line on existing utility poles in the City of Downey on the
following terms and conditions.
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION. 1. That California Cablesystems hereby agrees that its
trunk line and related facilities will be placed on existing utility
poles within the City as approved by the City of Downey. The facilities
to be installed are described in Exhibit "A" attached hereto and are
hereinafter referred to as the "Facilities ". California Cablesystems shall
provide evidence to the City prior to the start of construction that it
has the right to utilize the utility poles in question.
SECTION 2. That California Cablesystems hereby agrees to work closely
with appropriate City agencies and to abide by City regulations and City
inspection of the facilities to be installed in the City. In this regard,
California Cablesystems will prepare and submit to the City plans and
specifications and a schedule which shall detail the proposed construction
and installation of the facilities. Such plans, specifications and schedule
will be submitted and approved by the appropriate City department prior to
the start of construction. California Cablesystems shall adhere to the schedule
of construction unless a modification of the schedule is approved in advance
by the City.
At all times while the Facilities are in place, California Cablesystems will,
at its own cost and expense, keep and maintain facilities in good order and
safe condition.
SECTION 3. That California _Cablesystems will have sole and exclusive
obligation for safe and proper installation and operation of the Facilities
in the City of Downey and will hold the City of Downey free and harmless
and defend the City from all claims or damages resulting from or in
connection with the design, installation or operation of the Facilities.
SECTION 4. The City Clerk shall certify to the adoption of this
Resolution and shall provide for appropriate distribution thereof.
