A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
ANNEXATION OF CERTAIN AREAS TO THE LIGHTING MAINTENANCE DISTRICT
AD 121, ZONE II, AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT
TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC
PLACES WITHIN THOSE AREAS. (ANNEXATION 81/29 - FIRESTONE BOULEVARD)
WHEREAS, the City Council of the City of Downey on October 13, 1981, adopted
Resolution No. 4024 declaring its intention to order certain improvements; and
WHEREAS, on October 13, 1981, the City Council by Resolution No. 4024, set
November 10, 1981, at 7:30 p.m. in the Council Chambers of the Downey City Hall at
8426 Third Street, as the time and place for hearing protests to the proposed improve-
ment; and
WHEREAS, on November 10, 1981, at the time and place specified, a public hearing
was held in accordance with Resolution No. 4024, notice having been given in the manner
required by law. and the City Council did pass upon all written and oral protests
made in reference to the improvements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The boundaries of the area to be annexed to the Lighting Maintenance
District AD 121 are described on Plan No. 3 -24 -49 on file in the office of the City
Clerk and by this reference made a part hereof.
SECTION 2. The improvement consists of the furnishing of maintenance and energy
for street lighting installed in conjunction with Underground Utility District No. 11
as described in the Report of the City Traffic Engineer dated October 13, 1981, and
approved by the City Council.
SECTION 3. The entire estimated energy and maintenance costs of the improvement
shall be borne by the District and shall be paid by special assessment taxes levied
upon all the lands within said area.
SECTION 4. The improvements described in Resolution No. 4024 and the Report of
the City Traffic Engineer shall be made in the manner and at the time prescribed by law.
SECTION 5. The City Council finds that the Southern California Edison Company,
subject to the jurisdiction of the Public Utilities Commission of the State of California,
is the only contractor practically capable of servicing the street lighting improvement
in the manner provided for and as described herein. It is, therefore, ordered that the
improvements of the Lighting Maintenance District be carried out by the Southern
California Edison Company in accordance with the plans and specifications.
SECTION 6. The Mayor is authorized and directed to execute the contract with the
Southern California Edison Company for the improvement in accordance with the plans
and specifications and in accordance with the rates and rules filed by said Company
from time to time with the Public Utilities Commission of the State of California.
SECTION 7. The City Clerk shall certify to the adoption of this Resolution and
cause a certified copy thereof and the map or plan of the District to be filed with
the County Assessor whose role is used for the levy of assessments.
SECTION 8. The City Clerk shall certify to the adoption of this resolution.
