HomeMy WebLinkAboutResolution No. 4027 RESOLUTION NO. 4027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE THE FOLLOWING STREETS AND ALLEY: DOLAN STREET FROM 60.00 FEET NORTHERLY OF THE CENTERLINE OF FIRESTONE BOULEVARD 100.00 FEET WIDE TO THE SOUTHERLY LINE OF THIRD STREET 60.00 FEET WIDE; SECOND STREET FROM 191.66 FEET WESTERLY FROM THE WESTERLY LINE OF DOLAN STREET 60.00 FEET WIDE TO 285.00 FEET EASTERLY FROM THE EASTERLY LINE OF SAID DOLAN STREET; THIRD STREET FROM THE EASTERLY LINE OF SAID DOLAN STREET TO THE WESTERLY LINE OF BROOKSHIRE AVENUE 80.00 FEET WIDE; THE 18.00 FOOT PORTION OF THE ALLEY PARALLEL WITH AND 142.00 FEET NORTHERLY OF FIRESTONE BOULEVARD 100.00 FEET WIDE FROM THE WESTERLY LINE OF SAID DOLAN AVENUE WESTERLY 128.00 FEET THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey, upon recommendation of the Planning Commission, declares its intention to vacate those portions of Dolan Street, Second Street, Third Street and the alley located between Firestone Boulevard and Second Street, as shown on the attached copy of the map on file in the office of the City Clerk to which reference is made for further particulars, these public rights -of -way being vacated are described on Exhibit "A" attached hereto and by this reference made a part hereof. SECTION 2. The hour of 7 :30 p.m. on the 24th day of November, 1981, is hereby fixed as the time, and the Council Chambers in the City Hall at 8426 Third Street, Downey, California, is fixed as the place for hearing all persons interested in the proposed vacation of said streets and alley. SECTION 3. Notices of the proposed vacation shall be posted and published in the manner prescribed by Section 8322 of the Streets and Highways Code of the State of California. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 27th day of October, 1981. Milton R. Mackaig, Mayor / 7- ATTEST: " i City Clerk I HEREBY CERTIFY that the foregoing Resolution was approved and g g PP adopted at a regular meeting of the City Council of the City of Downey held on the 27th day of October, 1981, by the following vote, to wit: AYES: 5 Council Members: Swearingen, Quinn, Cormack, Jackman, Mackaig NOES: 0 Council Members: None ABSENT: 0 Council Members: None r Z 12 City Clerk RESOLUTION NO. 4027 EXHIBIT "A" PARCEL NO. 1 That portion of Dolan Street (formerly Doland Street) 60.00 feet wide in the City of Downey, County of Los Angeles, State of California, as shown on the map of the Subdivision of Block 15 of the Tract of the Downey Land Association recorded in Book 60, page 40 of Miscellaneous Records in the office of the County Recorder of said County lying southerly of the easterly prolongation of the northerly northerly line of said Block 15 and northerl of a line that is parallel with and 60.00 feet northerly measured at right angles from the centerline of First Street (now Firestone Boulevard) 60.00 feet wide as said street is shown on the map of said Subdivision of Block 15. Reserving to the City of Downey an easement for utilities, drainage and sewer in and under said Dolan Street. PARCEL NO. 2 That portion of Second Street 60.00 feet wide in said City of Downey, County of Los Angeles, State of California, as shown on the map of the Subdivision of Block 15 of the Tract of the Downey Land Association recorded in Book 60, Page 40 of Miscellaneous Records in the Office of the County Recorder of said County lying easterly of a line that is parallel with and westerly 191.66 feet from the westerly line of said Dolan Street 60.00 feet wide, and westerly of a line that is parallel with and easterly 295.00 feet from the easterly line of said Dolan Street 60.00 feet wide. Reserving to the General Telephone Company of California and Pacific Telephone and Telegraph Company an easement in and under the southerly 10.00 feet of said 60.00- foot -wide street. Also reserving an easement for drainage, and utilities in and under that portion of Second Street bounded by the easterly line of said Dolan Avenue and a line parallel with and 20.00 feet easterly of said easterly line of Dolan Avenue and also in that aortion of Second Street bounded by a line that is parallel with and 295.00 feet easterly from said easterly line of Dolan Street and a line that is parallel with end 235.00 feet easterly of said easterly line of Dolan Street. PARCEL NO. 3 That portion of Third Street 60.00 feet wide in said City of Downey, County of Los Angeles, State of California, as shown on County Surveyor's Map 8193 on file in the office of the County Surveyor of said County lying easterly of the north- easterly prolongation of the easterly line of said Dolan Street and westerly of a line that is 40.00 feet westerly of the centerline of Church Street 60.00 feet wide (now Brookshire Avenue) as said street is shown on the map of Tract 9118 as shown in map recorded in Book 120, Page 84 of Maps in the Office of the County Recorder of said County. Reserving to the City of Downey an easement for utilities, drainage and sewers in and under said Third Street. EXHIBIT "A" (Continued) - RESOLUTION NO. 4027 PARCEL NO. 4 That portion of that certain alley established by the Board of Supervisors September 6, 1927, and described in Book 22082, Page 241, Official Records of said County bounded on the west by a line that is parallel with and 128.00 feet westerly from the westerly line of said Dolan Street 60.00 feet wide and bounded on the east by the westerly line of said Dolan Street.
