HomeMy WebLinkAboutResolution No. 4002 RESOLUTION NO. 4002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING THE LOS ANGELES COUNTY BOARD OF SUPERVISORS TO STOP PROVIDING GENERAL FUND SUBSIDY TO LOS ANGELES COUNTY ANIMAL CONTROL CONTRACT SERVICE AREAS WITHOUT EQUITABLE DISTRIBUTION OF FUNDS TO ALL COMMUNITIES WHEREAS, the Los Angeles County Grand Jury Audit Report identified a substantial subsidy from the General Fund to pay for Animal Control ser- vices rendered to unincorporated and contracting agencies; and WHEREAS, the above subsidy is estimated to exceed $3 million for fiscal year 1981 -82, of which approximately $1.2 million is used to underwrite Animal Control services in County contract areas; and WHEREAS, there exists indisputable evidence that County Animal Control services inure to the benefit only of persons residing within County Animal Control's service area and not the entire County; and WHEREAS, the Audit Report excerpt attached hereto, marked Exhibits "A" and "A -1," clearly demonstrates the inequitable distribution of services and related charges which reflect an enormous subsidy to certain areas; and WHEREAS, County Animal Control now attempts to influence and inhibit Cities in their pursuit of alternative economical Animal Control services by utilizing vast financial resources gained from inequitable distribution of County General Fund revenues; and WHEREAS, a substantial amount of County General Fund revenue is derived from sources within this City with the intent to operate services that benefit the entire County, including residents of this City; and WHEREAS, this City already pays for its own Animal Control service and is now also required to subsidize County Animal Control services in other communities from general property taxation without any direct or in- direct benefit to the residents of this community or a pro rata share of the subsidy to the County; and WHEREAS, this inequity is tantamount to double taxation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the Mayor is hereby directed to request the Board of Supervisors of the County of Los Angeles to take immediate steps to stop County Animal Control from providing subsidy to any contract service area unless the Board similarly provides funds to this City for Animal Control services in amounts to be determined on a per capita or pro rata contribu- tion method. SECTION 2. That if no satisfactory solution to this matter is reached within a reasonable period of time, the City Attorney shall prepare a report to this Council on alternative steps which may be deemed appropriate. SECTION 3. That this City Council urges all surrounding Cities to respond to this matter with like resolve. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and provide for appropriate distribution thereof. APPROVED AND ADOPTED this llth day of August, 1981. „7,, ". Milton R.
