A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY GRANTING APPROVAL OF PERMISSIVE CONDITIONAL
USE PERMIT NO. 2 (SUVA STREET).
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOVE AS FOLLOWS:
SECTION 1.The City Council does hereby find and determine that
an application was duly filed by A. L. MacIntosh Company, with respect
to the real property described as follows: Bounded on the north by
Suva Street; on the west by the City Boundary line requesting a
Conditional Use Permit permitting a machine shop facility; that a public
hearing was duly held before the City Planning Commission on April 1,
1981; and studies and investigation reveal the following facts:
(1) The requested conditional use permit will not adversely
affect the purpose and intent of this Chapter or the City's
General Plan, or the public convenience or general welfare
of persons residing or working in the neighborhood thereof,
since the use requested is designed to not infringe upon a
nearby residential use nor create parking or traffic problems.
The proposed development will not adversely affect adjacent
land uses.
(2) The requested use will not adversely affect the adjoining
land uses and the growth and development of the area in
which it is proposed to be located, since adequate protection
using landscaping and building setbacks can be provided to
assure compatibility with abutting land uses, including an
enclosed building.
(3) The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use
in a manner not detrimental to the particular area.
(4) The traffic generated by the proposed use will not
impose an undue burden upon the streets and highways in
the area, since adequate off - street parking is being
provided with access only to Scout Avenue.
SECTION 2. The City Council further finds and determines
that facts exist as required inSection 9166.12 of the Downey
Municipal Code justifying the granting of a Permissive
Conditional Use Permit.
SECTION 3. Based upon the aforementioned findings, the City
Council hereby approves with respect to the property described
in Section 1, above, a Permissive Conditional Use Permit subject
to the following conditions:
1. This approval is based upon a revised plot plan and
elevation dated February 27, 1981. Deviations or
exceptions from the approved plot plan and elevation
shall not be permitted without the approval of the City
Planning Commission.
2. This approval is for a 45,000 square foot machine
shop and off - street parking in an R1 -6000 zone.
3. All lights used to illuminate any portion of building,
open space, or parking area shall be so arranged as to not
reflect the light directly on any adjacent properties or
public right -of -way.
4. Parkway trees shall be installed and permanently
maintained along the street frontage of Suva Street.

5. All landscaped areas shown on the plot plan shall be
enclosed by masonry curbing not less than six inches
in height and said landscaping shall be permanently
maintained in a neat and attractive manner.
6. Sidewalk shall be installed along the subject property
fronting on Suva Street, to the standards of the City
Engineering Division.
7. Parking, driveway and landscaping areas shall be
constructed and permanently maintained in conformance
with Section 9150 of the Downey Municipal Code.
8. Grading plans shall be approved by the City Engineering
Division and Building and Safety.
9. A water main extension and fire hydrants, fire sprinklers,
and automatic alarm system shall be installed to the standards
of the Department of Fire and City Engineering Division.
10. Sewer shall be constructed to the standards of the City
Engineering Division if connected within the Downey City limits.
11. A street light shall be installed on Suva Street and
applicant's property annexed into the Lighting Maintenance
District.
12. The parking area shall not be used for the storage of
materials or inventory unless the parking area is screened
with a 6' high solid masonry wall. Sufficient parking for
_ employees and customers shall be provided "on- site" at all
times.
13. A landscaping plan and building elevations shall be
approved by the Design Review Board.
14. No signs shall be permitted on the property or building
that would be located within Downey's jurisdiction.
15. A fifteen foot building setback shall be provided along
Suva Street and the setback area shall be landscaped.
16. There shall be no vehicular ingress or egress to Suva
Street, excepting a locked fire emergency gate.
17. There shall beno openings in the easterly wall of the
machine shop building.
18.The City Council reserves the right to add or amend
conditions.
SECTION 4. The permit hereby allowed is conditional upon the
privileges being utilized within one (1) year after the
effective date thereof, and if they are not utilized or construction
work is not begun within said time and carried diligently in
accordance with conditions imposed, this authorization shall become
void, and any privilege, permit or variance granted hereby shall
be deemed to have elapsed.
SECTION 5. The City Clerk shall certify to the adoption of this
Resolution.

I HEREBY CERTIFY that the foregoing Resolution was duly adopted
by the City Council of the City of Downey at a regular meeting thereof
held on the 8th day of June, 1981, by the following vote, to wit:
