A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
ANNEXATION OF CERTAIN AREAS INTO LIGHTING MAINTENANCE DISTRICT
AD 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE
STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES
WITHIN THOSE AREAS. (ANNEXATIONS 31/3 THROUGH 81/27)
WHEREAS, the City Council of the City of Downey, on April 29, 1981, adopted
Resolution No. 3951 declaring its intention to order certain improvements; and
WHEREAS, on April 29, 1981, the City Council by Resolution No. 3951 set
Tuesday, May 26, 1931, at 7:30 p.m., in the Council Chambers of the City Hall
at 8426 Third Street, as the time and place for hearing protests to the proposed
improvements; and
WHEREAS, on May 26, 1981, at the time and place specified, a public hearing
was held in accordance with Resolution No. 3951, notice having been given in the
manner required by law; and
WHEREAS, at the hearing, the City Council did pass upon all written and oral
protests made in reference to the improvements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. The boundaries of those areas to be annexed to Lighting Maintenance
District AD 121 are described on Plan Nos. and boundary descriptions on file in
the office of the City Clerk under Annexations 81/3 through 81/27 and by this
reference made a part hereof.
SECTION 2. The improvements consist of the installation of street lighting
standards and furnishing of maintenance and energy for those street lights
described in the report of the City Traffic Engineer dated April 29, 1981, as
approved by the City Council.
SECTION 3. The entire estimated cost of the improvements shall be borne by
the District and shall be paid by special assessment charged against all the lands
and improvements within said areas for the period beginning July 1, 1981.
SECTION 4. The improvements described in Resolution No. 3949 and the report
of the City Traffic Engineer, submitted pursuant to Resolution No. 3949 and approved
by Resolution No. 3950, shall be made in the manner and at the time prescribed by
law.
SECTION 5. The City Council finds that the Southern California Edison Company,
subject to the jurisdiction of the Public Utilities Commission of the State of
California, is the only contractor practically capable of serving the street
lighting improvement in the manner provided for and as described herein. It is,
therefore, ordered that the improvements of the Lighting District be carried out
by the Southern California Edison Company in accordance with the plans and
specifications.
SECTION 6. The Mayor is authorized and directed to execute the contract with
the Southern California Edison Company for the improvements in accordance with the
plans and specifications and in accordance with rates and rules filed by said
Company from time to time with the Public Utilities Commission of the State of
California.
SECTION 7. The City Clerk shall certify to the adoption of this resolution
and cause a certified copy thereof, along with diagrams and assessments, to be
filed with the County Auditor to provide for the collection of costs incurred and
further shall cause a copy of this resolution to be published once in the
Southeast News.
