HomeMy WebLinkAboutResolution No. 3944 RESOLUTION NO. 3944 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING APPROVAL OF PERMISSIVE CONDITIONAL USE PERMIT NO. 1 (SUVA STREET AND FOSTER BRIDGE BOULEVARD) AND RESCINDING RESOLUTION NO. 3938 THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that an appli- cation was duly filed by Balboa Construction Company, Inc., with respect to the real property described as follows: Bounded on the north by Foster Bridge Boulevard, Suva Street on the south, and Scout Avenue on the west; requesting a Conditional Use Permit permitting a mini - warehouse storage facility; that a public hearing was duly held before the City Planning Commission on March 18, 1981; and studies and investigation reveal the following facts: (1) The requested Conditional Use Permit will not adversely affect the purpose and intent of the Comprehensive Zoning Ordinance or the City's General Plan or the public convenience or general welfare of persons residing or working in the neighborhood thereof since design and use safeguards are being required to protect the value, character and atmosphere of all adjacent properties. (2) The requested use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located, since industrial uses exist to the west and south, a flood control settling basin to the north and the rear yards of residential uses to the east. The design of the project gives adequate protection of the area. (3) The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area since the mini - storage use will have a minimum of activity on the property. (4) The traffic generated by the proposed use will not impose an undue burden upon the streets and highways in the area since mini- storage facilities, once occupied, generate a minimum of traffic and, therefore, do not create traffic problems for the area. SECTION 2. The City Council further finds and determines that facts exist as required in Section 9166.12 of the Downey Municipal Code justifying the granting of a Permissive Conditional Use Permit. SECTION 3. Based upon the aforementioned findings, the City Council hereby approves with respect to the property described in Section 1, above, a Permissive Conditional Use Permit subject to the following conditions: (1) This approval is based upon a revised plot plan and elevation dated April 6, 1981. Deviations or exceptions from the approved plot plan shall not be permitted without the approval of the City Planning Commission. (2) This approval is for a mini - storage warehouse facility, caretaker's quarters, and one two foot by four foot entrance sign, as shown on the approved plot plan and elevation. (3) No permanent or portable signs shall be permitted in the planting or driveway areas. (4) There shall be no flags, banners or the like permitted on the property, except for those indicating the initial opening of the business, and they shall not exceed a 120 -day time period. (5) All lights used to illuminate any portion of the buildings or open spaces shall be so arranged so as to not reflect the light directly on any adjacent properties or public right -of -way. (6) A 15 foot wide landscaped setback shall be provided parallel to Suva Street. A 10 foot wide landscaped setback shall be provided parallel to Foster Bridge Boulevard, all of which shall be permanently maintained. RESOLUTION NO. 3944 Page 2 (7) Parkway trees shall be installed and permanently maintained along the street frontage of Suva Street and Foster Bridge Boulevard to the standards of the Department of Public Works. (8) Sidewalks shall be installed along the subject property fronting on Suva Street and Foster Bridge Boulevard to the standards of the City Engineering Division. (9) All utility lines shall be installed underground. (10) Grading plans shall be approved by the Divisions of City Engineering and Building & Safety. (11) A water main, fire service and facilities shall be installed to the standards of the Departments of Fire and Water and the Building & Safety and Engineering Divisions. (12) A sewer shall be constructed to the standards of the City Engineering Division. (13) Street lights shall be installed to the standards of the City Engineer- ing Division and the property annexed into the Lighting Maintenance District. (14) Customer parking shall be provided as shown on the approved plot plan. (15) Landscaping plans and building elevations shall be approved by the Design Review Board. (16) The height of Building "L" opposite R -1 development on the east shall not exceed 10 feet above the finished grade of such abutting properties located at 7330 and 7336 Foster Bridge Boulevard. Such requirement shall include the northerly 25 feet of the Church property to the south. The height of the building opposite the remaining Church property shall not exceed 10 feet above the finished grade of the parking area. (17) Approval of plans, landscaping, building elevations, fire service, utilities and street improvements shall be coordinated with the City of Bell Gardens. (18) Drainage catch basins on Foster Bridge Boulevard shall be modified to drain into the proposed drain line. (19) Five feet (5') shall be dedicated for the widening of Foster Bridge Boulevard. (20) The applicant shall accept surface drainage for abutting residential property to the east by recorded agreement. SECTION 4. The permit hereby allowed is conditional upon the privileges be- ing utilized within one year after the effective date thereof, and if they are not utilized or construction work is not begun within said time and carried diligently in accordance with conditions imposed by the Planning Commission, this authorization shall become void and any privilege, permit or variance granted hereby shall be deemed to have elapsed. SECTION 5. Resolution No. 3938 hereby is rescinded. SECTION 6. The City Clerk shall certify to the adoption of this Resolution and transmit copies to the applicant, Building & Safety Division, Planning Division, and Engineering Division.
