A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING CERTAIN PRIVATELY OWNED PARKING LOTS ELIGIBLE
FOR THE ENFORCEMENT OF PARKING VIOLATIONS IN DESIGNATED
HANDICAPPED SPACES.
WHEREAS, the local chapter of the California Association of Physically
Handicapped (CAPH) has requested that the City of Downey assist in improving
conditions for the handicapped community; and
— WHEREAS, Downey Municipal Code Section 9150.18(d) requires the designation
of handicapped parking spaces on private properties, pursuant to Section 22511.7
of the California Vehicle Code; and
WHEREAS, the California Vehicle Code authorizes the enforcement of parking
violations in designated handicapped parking spaces, pursuant to Sections
22507.8 and 22511.8; and
WHEREAS, the City of Downey may, by resolution, find and declare that there
are privately owned and maintained off - street parking facilities subject to
public traffic regulations and control.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. Pursuant to the provisions of Sections 21107.8 and 22507.8 of
the California Vehicle Code, no parking shall be permitted in spaces on certain
privately owned, leased or controlled off - street parking facilities which have
been designated for the exclusive use of the physically handicapped persons except
those vehicles displaying a distinguishing license plate or placard issued to
disabled persons, pursuant to Section 22511.5 of the California Vehicle Code or
to disabled veterans as specified in Section 9105 of said Code. Those certain
parking facilities are described on the attached Exhibit "A" which is hereby
made a part of this resolution.
SECTION 2. Pursuant to the provisions of Section 22511.8 of the California
Vehicle Code, unauthorized vehicles may be removed from disabled persons
designated parking spaces when notices of removal are conspicuously posted
immediately adjacent to and visible from each space or posted in a conspicuous
place at each entrance to the off - street parking facility.
SECTION 3. The City Clerk shall certify to the adoption of this resolution.
