A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING EXPRESS FINDINGS REGARDING MODIFICATION OF
UNIFORM CODES FOR BUILDING REGULATIONS
WHEREAS, the governing body of the City of Downey determines that
the modifications set forth below are, in fact, reasonably necessary
because of local conditions and each modification requires an express
finding for that modification.
NOW, THEREFORE, BE IT RESOLVED THAT:
SECTION 1. Each and every change effected in the Uniform Building
Code, Uniform Solar Energy Code, Uniform Housing Code, Uniform Mechanical
Code, Uniform Plumbing Code and Uniform Code For the Abatement of
Dangerous Buildings, 1979 Editions, or modification thereof dealing with
the subject matter of the respective change or modification hereby is
declared to be necessary because of conditions specifically determined
below:
(a) Section 301 (a) of the Uniform Building Code (UBC) has
been repealed. This section would not require permits for
fences not over 6 feet high, oil derricks, water tanks,
driveways, prefabricated swimming pools, and other items. If
left in the code these items could be installed in any location
and be in conflict with the City of Downey Zoning Ordinance
and building regulations.
(b) Section 1705 (a) of the Uniform Building Code has been
modified by adding a paragraph to include smoke detectors in
existing apartment houses when alterations, repairs, or additions
exceed $1000.00 in valuation. Research has proven smoke detectors
save lives and the cost of a battery operated smoke detector for
each dwelling unit is a small price to protect lives of occupants.
(c) Section 1705 (a) of the Uniform Building Code updates wording
of fire resistant standards for commercial zoned interior walls
and ceilings to be a minimum of 1/2" gypsum plasterboard or equal.
This item is needed to define noncombustible material which is
to provide life safety for occupants.
(d) Section 1807 (1) of the Uniform Building Code presently provides
for safety factors in areas of refuge as an alternate to automatic
sprinkler systems. This section will be changed to require safety
factors even tho sprinkler systems are not installed. These safety
factors for areas of refuge in a commercial buildings are needed
since fire zones have been eliminated, to protect life and safety
of occupants.
(e) Section (f) of the Uniform Building Code has been added to
include spark arrestors on heating appliances in which solid or
liquid fuel is used. This item is needed to provide spark arrestors
on wood burning stoves as well as fireplace chimneys. The current
code does not address this situation and wood burning stoves are
growing in popularity as they conserve energy.
(f) Section 3802 (b) of the Uniform Building Code updates the
safety of commercial and industrial buildings by requiring automatic
fire extinguishing systems when the total floor area exceeds 10,000
square feet. This provision shall apply to existing buildings, which
after additions will exceed 10,000 square feet of floor area. This
item is needed to provide life safety for occupants. A sprinkler
system is one of the best fire preventive systems there is and the
cost of installation can be recovered by lower insurance rates
within a few years.

(g) Section 1008 (c) (3) of the Uniform Plumbing Code has been
added to include a separate water supply system and shut -off valve
for each unit of an apartment building, condominium, townhouse,
stock cooperative and community apartment building. The code
presently requires a separate shut -off valve for each building.
This item is needed to protect the occupants of a unit that they
will have a supply of water even tho another unit is shut down for
repairs.
(h). Section 1213 (o) of the Uniform Plumbing Code has been added
to include a separate gas supply system and shut -off valve for each
unit of an apartment building, condominium, townhouse, stock
cooperative and community apartment building. The code presently
requires a separate shut -off valve for each building. This item
is needed to assure the occupants of a unit, they will have a
supply of gas even though another unit is shut down for repairs.
(i) Section 203 of the Uniform Solar Energy Code has been added
to include a penalty for starting work without a permit. By adding
this section all codes will be consistant regarding penalties.
(j) Section 255.19 of the National Electrical Code adopted by
Ordinance No. 577 February 13, 1979, has been modified by
permitting service drops over roofs to conform to State Public
Utility Commission G.O. 95. This was necessary due to a conflict
between the State Code and National Electric Code.
SECTION 2. The above listed findings shall be made available as a
public record and a copy thereof, with the modifications in questions, shall
be kept on file by the Building Official and filed with the State of California
Department of Housing and Community Development.
SECTION 3. The City Clerk shall certify to the adoption of this
Resolution.
