HomeMy WebLinkAboutResolution No. 3872 RESOLUTION NO. 3872 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983. (ANNEXATION 80/16) WHEREAS, the City Council of the City of Downey on September 9, 1980, adopted Resolution No. 3862 declaring its intention to order certain improvements; and WHEREAS, on September 9, 1980, the City Council by Resolution No. 3862 set Tuesday, October 14, 1980, at 7:30 p.m., in the Council Chambers of the City Hall at 8425 Second Street, as the time and place for hearing protests to the proposed improvements; and WHEREAS, on October 14, 1980, at the time and place specified, a public hearing was held in accordance with Resolution No. 3862, notice having been given in the manner required by law; and _ WHEREAS, at the hearing, the City Council did pass upon all written and oral protests made in reference to the improvements. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of that area to be annexed to Lighting Maintenance District AD 121 are described on Plan No. SL -310 and boundary description on file in the office of the City Clerk and by this reference made a part hereof. SECTION 2. The improvements consist of the installation of street lighting standards and furnishing of maintenance and energy for those street lights described in the report of the City Traffic Engineer dated September 9, 1980, as approved by the City Council. SECTION 3. The entire estimated cost of the improvements shall be borne by the District and shall be paid by special assessment charged against all the lands and improvements within said area for the period beginning July 1, 1981, and ending January 31, 1983. SECTION 4. The improvements described in Resolution No. 3860 and the report of the City Traffic Engineer, submitted pursuant to Resolution No. 3860 and approved by Resolution No. 3861, shall.be made in the manner and at the time prescribed by law. SECTION 5. The City Council finds that the Southern California Edison Company, subject to the jurisdiction of•the Public Utilities Commission of the State of California, is the only contractor practically capable of serving the street lighting improvement in the manner provided for and as described herein. It is, therefore, ordered that the improvements of the Lighting District be carried out by the Southern California Edison Company in accordance with the plans and specifications. SECTION 6. The Mayor is authorized and directed to execute the contract with the Southern California Edison Company for the improvements in accordance with the plans and specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof along with diagrams and assessments to be filed with the County Auditor to provide for the collection of costs incurred and further shall cause a copy of this resolution to be published once in the Southeast News. SECTION 8. The City Clerk shall certify to the adoption of this resolution.
