A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
GRANTING CONDITIONAL USE PERMIT NO.102
The City Council of the City of Downey does resolve as follows:
SECTION 1. The City Council does hereby find and determine that
an application was duly filed by Calvary Chapel of Downey, Inc., with
respect to the real property described as follows: 12808 Woodruff
Avenue requesting a Conditional Use Permit permitting a church facility
with a seating capacity of 2800, a parochial school with grades kindergarten
through eighth with a capacity of 750 students, gymnasium, church
offices, child care facilities and kitchen for banquet and socials;
that a public hearing was duly set for September 9, 1980, at 7:30 p.m.,
in the Council Chamber of the Downey City Hall, 8425 East Second Street,
Downey, California, and a notice of the date, time, place and purpose
of aforesaid hearing was duly given; that a hearing was duly held at
the aforementioned time and place. Studies and investigation made by
the City Council and in its behalf reveal the following facts:
(1) The requested conditional use permit will not adversely
affect the purpose and intent of this Chapter or the City's
General Plan, or the public convenience or general welfare of
persons residing or working in the neighborhood thereof, since
a church facility, including a parochial school is a permitted
use in the C -2 zone subject to a conditional use permit approval.
(2) The requested use will not adversely affect the adjoining
land uses and the growth and development of the area in which
it is proposed to be located, since adequate buffers and open
space exists to separate the proposed activity from any adverse
affect that might be generated upon adjoining land uses.
(3) The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in
a manner not detrimental to the particular area, since the lot
consists of 11.75 acres with the building covering 3.26 acres
with a remaining open space of 8.49 acres.
(4) The traffic generated by the proposed use will not impose
an undue burden upon the streets and highways in the area,
since Imperial Highway and Woodruff Avenue are both capable of
handling the increase of traffic that will be created by the
church operation.
SECTION 2. The City Council further finds and determines that
facts exist as required in Section 9166.12 of the Downey Municipal
Code justifying the granting of a Conditional Use Permit.
SECTION 3. Based upon the aforementioned findings, the Council
hereby grants with respect to the property described in Section 1,
above, a Conditional Use Permit subject to the following conditions:
1. This approval is based upon a plot plan dated July 21, 1980.
Deviations or exceptions from said plot plan shall not be
permitted without the approval of the City Planning Commission.
2. This approval is for a church with a seating capacity
for 2400 persons; a parochial school with grades kindergarten
through eighth with a capacity for 750 students; a gymnasium;
church offices, child care facilities and kitchen for banquet
and socials.
3. All lights used to illuminate any portion of buildings,
signs, open spaces, or parking area shall be so arranged as
to not reflect the light directly on any adjacent properties
or public right -of -way.

4. Damaged sections of curb and gutter shall be removed and
replaced with new curb and gutter, to the standards of the
City Engineering Division.
5. Damaged sidewalks shall be removed and replaced with new
sidewalk, to the standards of the City Engineering Division.
6. Trees shall be planted in empty tree wells, to the standards
of the City Engineering Division.
7..A11 catch basins shall be cleaned and kept free of debris,
to the standards of the City Engineering Division.
8. Replace any damaged or missing drainage grates, to the
standards of the City Engineering Division.
9. Irrigated landscaped planters covering not less than five
prcent (5 %) of the parking area shall be installed on the Wood-
ruff Avenue and Imperial Highway frontages within one year
from June 1, 1980.
10. Not later than June 1, 1981 irrigated landscaped planters,
in addition to those planters in the parking area, shall be
provided throughout the applicant's frontage along Imperial
Highway and Woodruff Avenue, except for driveway openings,
and shall be constructed to the standards of the Downey Municip-
al Code.
11. All conditions of approval for Conditional Use Permit #82
shall be a part of this approval.
12. The parochial school playground area and play equipment
shall not encroach upon required church parking area. Out-
-- door recreational uses and equipment shall not diminish or
obstruct any required church parking during services.
13. A landscaping plan and building elevations shall be review-
ed and approved by the Design Review Board.
14. All plans shall be reviewed and approved by the Fire Depart-
ment and Building and Safety Division.
15. Any Bus used for the transport of students and /or church
members shall be stored at the rear of the property (south-
easterly) when not in service.
16. The parochial school shall be subject to the requirements
of the Education Code of the State of California.
17. The existing plant nursery business shall be removed when
the church facility moves into the main building.
SECTION 4. The permit hereby allowed is conditional upon the
privileges being utilized within one (1) year after the effective
date thereof, and if they are not utilized or construction work is not
begun within said time and carried diligently in accordance with con -
ditions imposed by the City Council, this authorization shall become
-- void, and any privilege, permit or variance granted hereby shall be
deemed to have elapsed.
SECTION 5. This action shall become final and effective fifteen
(15) days after the date of the adoption of this Resolution.
SECTION 6. The City Clerk shall certify to the adoption of
this Resolution and shall transmit a copy to the Applicant, Building
and Safety Division, City Engineering Division, and Planning Division.
