HomeMy WebLinkAboutResolution No. 3740 RESOLUTION NO. 3740 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE EIGHTH DAY OF APRIL, 1980, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PRO- VISIONS OF THE CHARTER OF THE CITY OF DOWNEY AND FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY A PROPOSED AMENDMENT TO THE CHARTER OF SAID CITY WHEREAS, under the provisions of the Charter of the City of Downey, a regular general municipal election shall be held on the 8th day of April, 1980, for the election of three members of the City Council of said City for the full term of four years; and WHEREAS, the City Council of the City of Downey desires to submit to the qualified electors of said City at said election a proposed Charter amendment relating to the time of holding the general elections of the City, and the Council thereupon is authorized and directed by statute to submit the proposed amendment to the Charter to the qualified voters of said City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the Charter of the City of Downey, there shall be and there hereby is called and ordered held in the City of Downey, County of Los Angeles, State of California, on Tuesday, the 8th day of April, 1980, a regular general municipal election of the qualified electors of said City for the purpose of electing three members of the City Council of said City for the full term of four years. SECTION 2. That pursuant to Article XI of the Constitution and Title 4, Division 2, Chapter 3 of the Government Code of the State of California, it hereby is ordered that a proposal for the amendment to the Charter of the City of Downey be submitted to the electors at said general election to be held in said City on April 8, 1980. SECTION 3. The proposed amendment to the Charter of said City submitted to the voters shall be as follows: DOWNEY CITY CHARTER AMENDMENT NO. 1 Shall Section 1300 of Article XIII of the Downey City Charter be amended to read as follows: Section 1300 General Municipal Elections. General Municipal Elections for the election of officers, except members of the Board of Education, and for such other purposes as the City Council may prescribe shall be held in the City on the same date and at the same time as the Statewide Direct Primary. The first such General Municipal Election shall be held in the year 1982. SECTION 4. That the foregoing proposal hereby submitted shall appear upon the ballots for said general municipal election in substan- tially the following form: Shall proposed Charter Amendment No. 1 amending Yes Section 1300 of Article XIII providing that General Municipal Elections shall be held on the date and at the time of the Statewide Direct Primary Elections be ratified No SECTION 5. That the ballots to be used at said 1980 election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. -1- RESOLUTION NO. SECTION 6. That the City Clerk of said City is hereby authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully con- duct said election. SECTION 7. That the polls for said election shall be open at seven o'clock a.m. of the day of said election and shall remain open con- tinuously from said time until seven o'clock p.m. of the same day when — said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 8. That in all particulars not recited in this Resolution, said elections shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 9. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instruc- ted and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 10. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. SECTION 11. That this Resolution shall take effect immediately. PASSED, APPROVED AND ADOPTED this 28th day of November, 1979. Kenneth J., 1 er, Mayor ATTEST: - / / ) .....„/ City Clerk I HEREBY CERTIFY that the foregoing Resolution was adopted by the City Council of the City of Downey at a regular meeting thereof held on the 28th day of November , 1979, by the following vote, to wit: AYES: 3 Council Members: Jackman, Swearingen, Greene NOES: 0 Council Members: None ABSENT: 0 Council Members: None ABSTAIN: 2 Council Members: Mackaig, Miller Z I71? < X/7 i City Clerk -2- CITY ATTORNEY'S IMPARTIAL ANALYSIS DOWNEY CITY CHARTER AMENDMENT NO. 1 This proposed amendment, if adopted, will amend Section 1300 of the Downey City Charter to provide that the General Municipal Elections starting in the year 1982 will be held on the same date and at the same time as the Statewide Direct Primary. It now is provided that the Statewide Direct Primary shall be held on the first Tuesday after the first Monday in June in each even - numbered year. If the date of the Statewide Direct Primary, as presently set forth, is changed, the General Municipal Election of the City of Downey likewise would change.
