A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS
WITHIN LIGHTING MAINTENANCE DISTRICT AD 121 FOR THE FISCAL
YEAR 1979 -80
WHEREAS, the City Council by Resolution No. 3675 proposed to levy and
collect assessments within Lighting Maintenance District AD 121 pursuant to the
provisions of the Landscaping and Lighting Act of 1972 (Part 2, Division 15 of
the California Streets and Highways Code); and
WHEREAS, by said Resolution No. 3675 the City Council ordered the City
Engineer to prepare and file a report for Lighting Maintenance District AD 121
for the 1979 -80 Fiscal Year pursuant to the Landscaping and Lighting Act of 1972
per Section 22585 of the California Streets and Highways Code; and
WHEREAS, the City Engineer did prepare and file such a report and the same
was approved by the City Council on the 29th day of May, 1979, by Resolution
No.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That in order to maintain and service street lighting facilities
within Lighting Maintenance District AD 121 for the Fiscal Year 1979 -80, it is
the intention of the City Council of the City of Downey to levy and collect assess-
ments pursuant to the provisions of the Landscaping and Lighting Act of 1972
(Part 2 of Division 15 of said Code.)
SECTION 2. That the maintenance and servicing of the public lighting
facilities in, on and along public streets within the District will be, in the
opinion of the City Council of the City of Downey, to the benefit of the assessable
properties within the District. Assessable properties are those within the
District that have been annexed into the District by previous resolutions caused
by voluntary installation of street lights and by requirements of various planning
cases or Section 8100 of the Downey Municipal Code.
SECTION 3. That reference hereby is made to the report of the City Engineer,
on file with the City Clerk and available for public inspection, of the proposed
assessments upon assessable lots and parcels of land within the District, in-
cluding changes from the previous fiscal year's assessment and assessable lots.
SECTION 4. That a new assessment zone (Zone VI) be considered for the
property along Firestone Boulevard between Old River School Road and the westerly
City Limits as shown and described by Plan No. SL -213 and boundary description on
file in the office of the City Clerk. Said property is to be concurrently de-
annexed from existing Zone II, all as described in the previously referenced report
by the City Engineer.
SECTION 5. Notice is hereby given that on June 12, 1979, at 7:30 o'clock p.m.
in the Council Chambers of said City of Downey in the City Hall located at 8425
Second Street, Downey, CA, all interested persons may appear before the City
Council and be heard concerning the services to be performed, the proposed assess-
ment and all other matters relating thereto.
Protests must be in writing and must be filed with the City Clerk prior to
the conclusion of the hearing. Any such protest shall state all grounds of the
objection, and if filed by the property owner, shall contain a description
sufficient to identify the property.
i SECTION 6. The City Clerk shall cause notice of the hearing to be given by
causing the Resolution of Intention to be published, posted and mailed in the
manner required by Part 2 of Division 15 of the Streets and Highways Code.
SECTION 7. The City Clerk shall certify to the adoption of this Resolution.
