A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO ANNEX CERTAIN AREAS INTO THE
LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN
AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING
FIXTURES ON THE STREETS AND PUBLIC PLACES UNTIL
JANUARY 31, 1983, (ANNEXATIONS 79/2 through 79/21)
WHEREAS, the City Council by Resolution No. 3658 proposed to annex certain
areas into the Lighting Maintenance District AD 121 pursuant to the provisions of
the Landscaping and Lighting Act of 1972 (Part 2 of Division 15 of the California
Streets and Highways Code); and
WHEREAS, by said Resolution No. 3658 the City Council ordered the City
Engineer to prepare a report pursuant to Article 4 of Chapter 1 of Part 2 of
Division 15 of the California Streets and Highways Code; and
WHEREAS, the City Engineer did prepare and file such a report and same was
approved by the City Council on the 10th day of April, 1979, by Resolution
No. 3659.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1: That the public interest and convenience require, and it is the
intention of the City Council of the City of Downey to order the annexation of
certain areas into the Lighting Maintenance District AD 121, and to maintain and
furnish electrical current to street lighting fixtures located on streets within
the City of Downey as shown on Plan Nos. SL 100/59, SL 100/44, SL 101, SL 189,
SL 192, SL 235, SL 242, SL 247, SL 297, SL 304, SL 305, SL 316, SL 317, SL 341,
SL 342, SL 343, SL 344 and SL 345 on file in the office of the City Clerk, from
July 1, 1979, until January 31, 1983, in accordance with the Report of the City
Engineer dated April 10, 1979, on file in the office of the City Clerk and by
which this reference is made a part hereof.
SECTION 2: These annexations, in the opinion of the City Council, are of more
than ordinary benefit and the Council hereby makes the costs of all expenses, work,
improvements, energy, and maintenance chargeable upon the zones within the District
benefitted. The zones within the District are those portions of the City of Downey
shown on the above specified plans on file in the office of the City Clerk, on
which the boundaries, thereof are described by boundary line. Reference is hereby
made to the plans for a complete and detailed description of the zones. The plans
on file shall govern for all details as to the extent of the assessments.
SECTION 3: Any lots or parcels of land known as public property, which are
included in the District, shall be exempt from assessment in accordance with
Section 22663 of the California Streets and Highways Code.
SECTION 4: The improvements contemplated shall be done under the provisions of
Chapter 6 of Part 2 of Division 15 of the California Streets and Highways Code
(Section 22675 et seq.).
SECTION 5: Collection of assessments caused by this resolution shall be made
pursuant to the methods described by Article 2 of Chapter 4 of Part 2 of Division 15
,_._. of the California Streets and Highways Code (Section 22645 et seq.) .
SECTION 6: Notice hereby is given that on May 8, 1979, at 7:30 o'clock p.m.
in the Council Chambers of the City of Downey in City Hall at 8425 Second Street,
Downey, California, all interested persons may appear before the City Council and
be heard concerning annexation into the District and all other matters relating
thereto.
Protests must be in writing and must be filed with the City Clerk prior to the
conclusion of the hearing. Any such protest shall state all grounds of the objection
and shall contain a description sufficient to identify the property.

SECTION 7: The City Clerk shall cause notice of the hearing to be given
pursuant to Article 2 of Chapter 2 of Part 2 of Division 15 of the California
Streets and Highways Code (Section 22550 et seq.).
SECTION 8: The City Clerk shall certify to the adoption of this resolution.
