HomeMy WebLinkAboutResolution No. 3649 RESOLUTION NO. 3649 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A POLICY AND APPROVING DESTRUCTION OF CERTAIN RECORDS WITHIN THE POLICE DEPARTMENT WHEREAS, the Chief of Police has advised the City Council that certain records within the Police Department of said city are neither required by statute nor necessary for the operation of the department after a period of five years; and WHEREAS, the City Council finds that the destruction of said records will not in any way interfere with the services and functions of the Police Department or other city departments; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. As authorized by Section 34090 of the Government Code of the State of California, the City Council hereby approves the destruction of the following records which are in charge of the Chief of Police of the City of Downey, and establishes the policy of retaining the most recent five complete years of personnel records, unless there is litigation pending: (1) Departmental records (including Performance Evaluation Ratings, complimentary comments and complaints) for the years through and including 1973. SECTION 2. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect. — APPROVED AND ADOPTED this 13th day of March , 1979. t e--deee:A;r62 4 LAZAILdsc o L_ William L.
