A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY OBJECTING TO THE CALIFORNIA
TRANSPORTATION COMMISSION'S RESTRICTIVE TIP
GUIDELINES CONCERNING PROGRAMMING AND PRIORI-
TIZATION OF FEDERAL AID URBAN FUNDS
WHEREAS, Assembly Bill 402, enacted in 1977, created the
California Transportation Commission (CTC), and gave the California
Transportation Commission certain responsibilities with regard to
State Transportation programs, however still recognizing the sovereignty
of local agencies and the importance of obtaining local input; and,
WHEREAS, Assembly Bill 1 402 requires that MAJOR projects be
prioritized and that the CTC notify each area of the fund estimates so
that Federal and State funded programs will be consistent with these
funding levels; and,
WHEREAS, the CTC's guidelines now require prioritizing by local
agencies of all State and Federally funded programs, with the total program
constrained to the exact amount of the fund estimate, which guidelines
are far more restrictive in the areas of local programming than intended
by Assembly Bill 1 402, and required by Federal agencies; and,
WHEREAS, the CTC's TIP guidelines were developed without due
consideration of local input, and do not reflect the local budgetary
processes and funding problems, as well as the problems of maintaining
project schedules, because of considerations beyond local control.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY, does
hereby resolve as follows:
SECTION 1. That the City of Downey goes on record in opposition
to the CTC's TIP guidelines which remove desired programming flexibility
and require the prioritizing of all local projects funded with money
passing through the State Highway Account.
SECTION 2. That the California Legislature provide relief,if
the CTC will not, from the overly restrictive interpretation of Assembly
Bill 402, recognizing that the TIP is prepared before local budgets are
adopted and flexible programming in an amount equal to 50% more than
the estimated available funds is necessary to allow local agencies to
make the most efficient use of these funds.
SECTION 3. The City Clerk shall certify to the adoption of this
Resolution and forward copies to the City's representatives in the
California State Legislature;the Chairman of the Senate and Assembly
Transportation Committees; the California Transportation Commission;
the Los Angeles County Transportation Commission; the Governor of the
State of California; and the Director of the Department of Transportation.
