HomeMy WebLinkAboutResolution No. 3618 RESOLUTION NO. 3618 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING EXPRESS FINDINGS REGARDING MODIFICATION OF r UNIFORM CODES FOR BUILDING REGULATIONS WHEREAS, pursuant to Health and Safety Code Sections 17958.5 and 17958.7 a city may make such modifications in the requirements of the housing regulations adopted pursuant to Health and Safety Code Sections 17912 and 17922 as it determines to be reasonably necessary because of local conditions; and WHEREAS, the governing body of the City of Downey determines that the modifications set forth below are, in fact, reasonably necessary because of local conditions and each modification requires an express finding for that modification. NOW, THEREFORE, BE IT RESOLVED THAT: SECTION 1. Each and every change effected in the Uniform Building Code, Uniform Housing Code, Uniform Mechanical Code, Uniform Plumbing Code, and Uniform Code For the Abatement of Dangerous Buildings, 1976 Editions, or modification thereof dealing with the subject matter of the respective change or modification hereby is declared to be necessary because of conditions specifically determined below: (a) Sections 1304 and 1404 of the Uniform Building Code (UBC) have been modified by adding a paragraph regulating metal bars, _., grilles, grates or similar devices installed in the emergency egress or rescue openings of bedrooms. The modification is the same as that approved for the 1979 edition of the Uniform Building Code and is necessary to protect lives of occupants of dwellings who feel a need to have additional security on their doors or windows. The probability of crime may be greater than the probability of injury due to fire. (b) Section 1314 of the Uniform Building Code has been added to regulate security and safety devices for apartments to reduce burglary in such a manner so as not to impede egress from an apartment should an emergency occur. (c) Sections 1807 and 1907 of the Uniform Building Code and Uniform Building Code Standard No. 18 -1 have been updated to be identical to the 1979 edition of the Uniform Building Code and are necessary to incorporate the latest research regarding life and safety of occupants in high rise buildings. (d) Section 2905 (g) of the Uniform Building Code updates sub- division soil report, requirements to equal those in the State of California Subdivision Act. (e) Section 3302 (g) of the Uniform Building Code has been added to clarify the requirement for pedestrian walkway exits when contiguous with driveways. This item is needed to provide life safety for occupants having restricted paths of exit to a public way. The current code does not address this situation. (f) The first paragraph of Section 3310 (b) of the Uniform Building Code has been modified for consistancy of exit court widths and does not add any new requirements. (g) Section 1310 (d) of the Uniform Plumbing Code (UPC) was adopted by Ordinance 485 to require water heaters to be securely fastened to eliminate tipping or overturning. This modification was needed to provide occupant safety in the seismically active area of Downey. SECTION 2. The above listed findings shall be made available as a public record and a copy thereof, with the modifications in question, shall be kept on file by the Building Official and filed with the State of California - Department of Housing and Community Development.
