A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO ANNEX A CERTAIN AREA INTO THE
LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN AND
FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON
THE STREETS AND PUBLIC PLACES UNTIL JANUARY 31, 1983
(ANNEXATION 78/24 - Donovan Street)
WHEREAS, the City Council by Resolution No. 3607 proposed to annex a certain
area into the Lighting Maintenance District AD 121 pursuant to the provisions of
the Landscaping and Lighting Act of 1972 (Part 2 of Division 15 of the California
Streets and Highways Code); and
WHEREAS, by said Resolution No. 3607 the City Council ordered the City
Engineer to prepare a report pursuant to Article 4 of Chapter 1 of Part 2 of
Division 15 of the California Streets and Highways Code; and
WHEREAS, the City Engineer did prepare and file such a report and same was
approved by the City Council on the 14th day of November , 1978, by
Resolution No. 3608 .
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1: That the public interest and convenience require, and it is the
intention of the City Council of the City of Downey to order the annexation of a
certain area into the Lighting MaintenanceDistrict AD 121, and to maintain and
furnish electrical current to street lighting fixtures located on Donovan Street,
between Glynn Avenue and Brookshire Avenue, in the City of Downey as shown on
Plan No. SL 266 on file in the Office of the City Clerk, from July 1, 1979, until
January 31, 1983, in accordance with the Report of the City Engineer dated
November 14, 1978, on file in the office of the City Clerk and which by this reference
is made a part hereof.
SECTION 2: This annexation, in the opinion of the City Council, is of more
than ordinary benefit and the Council hereby makes the costs of all expenses, work,
improvements, energy, and maintenance chargeable upon the zone within the District
benefitted. The area within the District is that portion of the City of Downey
shown on the above specified plan on file in the office of the City Clerk, on which
the boundaries thereof are described by boundary line. Reference is hereby made
to the plan for a complete and detailed description of the area. The plan on file
shall govern for all details as to the extent of the assessments.
SECTION 3: Any lots or parcels of land known as public property, which are
included in the District, shall be exempt from assessment in accordance with Section
22663 of the California Streets and Highways Code.
SECTION 4: The improvements contemplated shall be done under the provisions of
Chapter 6 of Part 2 of Division 15 of the California Streets and Highways Code
(Section 22675 et seq.).
SECTION 5: Collection of assessments caused by this resolution shall be made
pursuant to the methods* described by Article 2 of Chapter 4 of Part 2 of Division 15
of the California Streets and Highways Code (Section 22645 et seq.).
SECTION 6: Notice hereby is given that on December 12, 1978, at 7:30 o'clock
p.m. in the Council Chambers of the City of Downey in City Hall at 8425 Second Street,
Downey, California, all interested persons may appear before the City Council and
be heard concerning annexation into the District and all other matters relating
thereto.
Protests must be in writing and must be filed with the City Clerk prior to the
conclusion of the hearing. Any such protest shall state all grounds of the objection
and shall contain a description sufficient to identify the property.
SECTION 7: The City Clerk shall cause notice of the hearing to be given
pursuant to Article 2 of Chapter 2 of Part 2 of Division 15 of the California
Streets and Highways Code (Section 22550 et seq.).
SECTION 8: The City Clerk shall certify to the adoption of this resolution.
