A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING THAT AN UNDERGROUND UTILITY DISTRICT BE FORMED
PURSUANT TO RESOLUTION NO. 3581 (DISTRICT NO. 10
FIFTH STREET)
WHEREAS, pursuant to Resolution No. 3581 a public hearing was held on
August 22, 1978, by the City Council of the City of Downey; and
WHEREAS, notice of such hearing was given in the manner required by law; and
WHEREAS, such hearing duly has been held and all persons interested were
given an opportunity to be heard.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That it hereby finds and determines that the public necessity,
health, safety and welfare require the removal of poles, overhead wires and
associated structures and the underground installation of wires and facilities
for supplying electrical, communications or similar or associated service in the
City of Downey along Fifth Street, a major arterial highway extensively used by
the general public and carrying a heavy volume of vehicular traffic, between
Brookshire Avenue and Downey Avenue, as shown on Plan No. 3 -2 -48. The area within
Underground Utility District No. 10 is further described by legal description filed
in the Office of the City Clerk along with Plan No. 3 -2 -48 which by this reference
are made a part hereof.
SECTION 2. Those poles, overhead wires and associated overhead structures on
Fifth Street between Brookshire Avenue and Downey Avenue as shown on Plan No. 3 -2 -48
shall be removed and underground installations completed in said Underground Utility
District not later than September 30, 1979, provided, however, utility companies
upon a showing that they cannot comply with such limitations may have extensions of
time. The conversion of private property services by the owners shall be completed
by April 30, 1979.
SECTION 3. The City, within ten (10) days after the adoption of this Resolution
shall mail a copy of the same and a copy of Chapter 5, Article VII of the Downey
Municipal Code to affected property owners as such are shown on the last equalized
assessment roll and to the affected utilities.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
