A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO FORM AN ASSESSMENT DISTRICT
FOR THE MAINTENANCE AND SERVICING OF PUBLIC STREET
LIGHTING FACILITIES WITHIN THE BOUNDARIES OF THE
TERRITORY INCLUDED IN ASSESSMENT DISTRICT NO. 121
WHEREAS, the City Council by Resolution No. 3573 proposed to form an Assessment
District pursuant to the provisions of the Landscaping and Lighting Act of 1972
(Part 2, Division 15 of the California Streets and Highways Code); and
WHEREAS, by said Resolution No. 3573the City Council ordered the Engineer to
prepare a report pursuant to Section 22585 of the Streets and Highways Code; and
WHEREAS, the City Engineer did prepare and file such a report and the same was
approved by the City Council on the 11th day of July, 1978, by Resolution No.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest and convenience require and it is the
intention of the City Council of the City of Downey to order the formation of an
Assessment District and to levy and collect assessments pursuant to the provisions of
said Landscaping and Lighting Act of 1972, (Part 2 of Division 15 of said Streets
and Highways Code).
SECTION 2. The improvements consist of the maintenance and servicing of the
public lighting facilities in, on and along the public streets within the City and the
proposed Assessment District designated at A.D. No. 121, lies generally within the
entire City limits.
SECTION 3. Reference hereby is made to the report of the Engineer on file with
the City Clerk and open to inspection, for a full detailed description of the
improvements, the boundaries of the Assessment District and any zones therein, and
the proposed assessments upon assessible lots and parcels of land within the District.
That said proposed maintenance and servicing in the opinion of the City Council
of the City of Downey will be to the benefit of the property lying within the described
boundaries of the proposed Assessment District, as said Assessment District is
described and defined in said Engineer's report.
SECTION 4. Notice hereby is given that on July 25, 1978, at 7:30 o'clock p.m.
in the Council Chamber of said City of Downey in the City Hall located at 8425 Second
Street, Downey, California, all interested persons may appear before the City Council
and be heard concerning the formation of the District, the extent of the District,
the services to be performed and the proposed assessment and all other matters
relating thereto.
Protests must be in writing and must be filed with the City Clerk prior to the
conclusion of the hearing. Any such protest shall state all grounds of the objection
and if filed by the property owner shall contain a description sufficient to identify
the property.
SECTION 5. The City Clerk shall cause notice of the hearing to be given by
causing the Resolution of Intention to be published, posted and mailed in the manner
required by Part 2 of Division 15 of the Streets and Highways Code.
SECTION 6. The City Clerk shall certify to the adoption of this Resolution.
