HomeMy WebLinkAboutResolution No. 3526 RESOLUTION NO. 3526 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING AN APPEAL IN ZONE VARIANCE CASE NO. 5 WHEREAS, an application was submitted to the Planning Commission for a Zone Variance to establish a residential lot with less than the required street frontage width on property located at 8515 Cherokee Drive in Downey; and WHEREAS, the proposed lot would establish a lot frontage of 12 feet at the street line which would not be in keeping with the frontage widths within the '—' neighborhood; and WHEREAS, the Planning Commission at its meeting of February 15, 1978, held a public hearing thereon; and WHEREAS, at the conclusion of said hearing and discussion by the Commission, the vote to deny the variance was 5 to 0 and thereby denied; and WHEREAS, the applicant thereafter appealed to the City Council of the City of Downey, and public notice having been given in the manner provided by law and a hearing held by the City Council on March 14, 1978, and evidence for and against said application having been heard and considered by the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. City Council finds: (a) That the General Plan of the City provides for single family residential lots in the area in question; (b) That the general character of the neighborhood is developed and used by single family units with lot frontage widths in keeping with Zoning Ordinance requirements; (c) That the creation of a lot with a 12 foot wide street frontage width on the property in question would be inconsistent and incompatible with the surrounding and adjoining properties; (d) That the creation by this lot split would result in two undersized lots. SECTION 2. The City Council concludes: (a) That no special conditions or circumstances exist that is peculiar to the land which are applicable to other lands in the same vicinity to justify the grant of zone variance for the lot in question; (b) That literal interpretation of the provisions of the zoning ordinance would not deprive the applicant of rights commonly enjoyed by other properties in the same vicinity and zone in which the property is located; (c) That the granting of the zone variance would be inconsistent with the purpose and intent of the exist- ing comprehensive zoning plan. SECTION 3. The decision of the Planning Commission is affirmed, the appeal is denied, the request for the zone variance shall not be granted. SECTION 4.
