A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY AUTHORIZING A REDUCTION OF PARKING SPACES
(10909 NEW STREET)
WHEREAS, that certain property in the City of Downey known as 10909 New
Street is located within the boundaries of a parking assessment district; and
WHEREAS, the owner of said property has applied to the City Council for
relief from providing the required off street parking spaces on said property;
and
WHEREAS, the applicant has filed copies of agreements to provide
adequate alternate off street parking; and
WHEREAS, the applicant agrees to provide additional off street parking
for any spaces lost through agreement cancellations; and
WHEREAS, said property owner has applied to the Council for the reduction
in the minimum amount of $2,500 all pursuant to Section 9150.24 of the Downey
Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The City Council finds that the conditions set forth in
Section 9150.24 of the Downey Municipal Code are applicable to and have been
satisfied by the property known as 10909 New Street, Downey, California, so
long as additional off street parking is provided in accordance with
Exhibits A, B, and C attached hereto and by this reference made a part hereof.
SECTION 2. There hereby is waived the requirement of eighty (80) off
"' street parking spaces for said described property and this waiver shall be
effective upon the payment to the City of the sum of $0.00 for each parking
space waived. This waiver shall terminate in the event parking is not
maintained in accordance with Exhibits A, B, and C.
SECTION 3. The City Clerk shall certify to the adoption of this
resolution.
APPROVED AND ADOPTED this 28th day of February , 1978.
