Home My WebLink AboutResolution No. 3467 RESOLUTION NO. 3467 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING THAT THE UNOCCUPIED STRUCTURES WITHIN THE 105 FREEWAY CORRIDOR ARE A THREAT TO PUBLIC HEALTH AND SAFETY WHEREAS, Assembly Bill 1833 was adopted by the State Legislature and signed by the Governor of the State of California as an urgency measure, to become effective immediately; and, WHEREAS, under said bill the Department of Transportation of the State of California, is required to proceed expeditiously to remove or demolish or cause to be removed or demolished, all struc- tures that are not lawfully occupied and are a threat to public health and safety or have been declared a nuisance, or have been found to be hazardous and unsafe pursuant to the City's ordinances, or have been found by that City's legislative body to be a threat to public health and safety; and, WHEREAS, there are 494 structures in the 105 Freeway Corridor within the City limits of the City of Downey, which are not lawfully occupied and which have been continually damaged and vandalized over the past five years and are unsafe and a threat to public health and safety. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That all structures as set forth in Exhibit A hereof within the 105 Freeway Corridor in the City of Downey are not lawfully occupied and are hereby declared a nuisance. SECTION 2. All structures as set forth in Exhibit A hereof within the 105 Freeway Corridor in the City of Downey have been found to be unsafe and hazardous in accordance with the provisions of Chapter 2, Article 8 of the Downey Municipal Code. SECTION 3. All structures as set forth in Exhibit A hereof within the 105 Freeway Corridor in the City of Downey are declared by the City Council of the City of Downey to be a threat to public health and safety because of the numerous incidents of crime, vandalism, and fires, which have been occurring among these structures since 1972. SECTION 4. The California Department of Transportation is hereby requested to expeditiously make such motions before the Court having jurisdiction in order to authorize prompt removal or demolition of said structures, in accordance with the provisions of Section 405.2 of the Streets and Highways Code of the State of California. SECTION 5. The action requested hereby is solely for the purpose of abating a serious threat to the health and safety of persons residing within or in the vicinity of the right of way of Route 105 within the City of Downey, and shall not be construed as having any bearing on the eventual construction of a freeway on Route 105, nor shall be construed as being preparatory activities for such construction. SECTION 6. The City Clerk shall certify to the adoption of this resolution and transmit copies to the California Department of Trans- portation for its action.
