A RESOLUTION OF THE CITY OF DOWNEY AUTHORIZING
AND DIRECTING THE CITY MANAGER TO EXECUTE TRAINING
AGREEMENTS BETWEEN THE POLICE DEPARTMENT OF THE
CITY OF DOWNEY AND THE STATE OF CALIFORNIA
DEPARTMENT OF HIGHWAY PATROL
WHEREAS, the State of California Department of Highway Patrol
requires written training agreements from any agency participating in
their training programs; and
WHEREAS, the Police Department of the City of Downey desires from
time to time to participate in certain training programs sponsored and
administered by the California Department of Highway Patrol; and
WHEREAS, resolution of the Downey City Council is required for the
1977/78 fiscal year.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
DOWNEY, CALIFORNIA, AS FOLLOWS:
That the City Manager is hereby authorized and directed to sign
such training agreements when required for the fiscal year 1977/78, in
the form attached hereto.

TRAINING AGREEMENT - •
THIS AGREEMENT, made and entered into this 19th day
of May 1977 Y
by and between the State of California, acting
by and through the Department of California Highway Patrol, hereinafter
called CRP and the City of Downey hereinafter called
contractor. •
WITNESSETH, by and in consideration of the covenants and
conditions herein contained, the CHP and the contractor do hereby
agree as follows:
1. CHP agrees to allow contractor to attend training classes
during the period(s) as follows: Initial Motorcycle Training Class 7 -77
9/6 -16, 2 trainees, & 5 -77 10/4-14, 2 trainees.
2. CHP agrees to provide living, dining, and classroom
facilities as required.
3. As consideration for the use of the Academy facilities,
cont ractor agrees to pay CHP upon receipt of an invoice in accordance
with the following:
Per resident student . . . . .$ 25.0Q per day
Per non - resident student . . .$ TVA per day
Instruction fee . . . . . . . .$ 1r no per 8 hour day
TOTAL not to exceed . . . . . .$ 9 690_0n
4. All training is conducted on a space available basis.
In the event contractor's personnel occupy CHP Academy as a resident
and do not remain in residence for the duration of training, but
complete training course, contractor agrees to pay full residence fees
for the entire training period.

5. Contractor agrees to indemnify, defend, and save
harmless CRP, its officers, agents, and employees from any and
all claims and losses accruing or resulting to any person, firm,
or corporation ion who may be injured or damaged by the contractor in
the performance of this agreement.
6. Contractor shall be responsible for paying any cost
incurred d b CHP for facility damage caused by the willful or
malicious misconduct of contractor's trainees.
7. This agreement shall become effective when signed
by both parties, upon u on CHP's receipt of a resolution covering
the agreement. . Training shall not be authorized until the resolution

is on file with CHP.
8. This agreement may be amended by mutual consent of the
parties hereto.
• 9. Notices and communications hereunder shall be sent
to the addresses appearing below the signatures.
