HomeMy WebLinkAboutResolution No. 3394 RESOLUTION NO. 3394 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING AN APPEAL IN ZONE EXCEPTION CASE NO. 1327 WHEREAS, an application was submitted to the Planning Commission for a variance to establish and maintain a caretaker's quarters, in- cluding kitchen and sleeping facilities in conjunction with a T.V. and Appliance Store on property located at 12111 Lakewood Boulevard in Downey; and WHEREAS, the proposed use would permit a residential use within the C -3 zone, which use is specifically prohibited within said zone; and WHEREAS, the Planning Commission at its meetings of February 2, 1977 and February 16, 1977, held a public hearing thereon; and WHEREAS, at the conclusion of said hearing and discussion by the Commission, the vote to deny the zone exception was 5 to 0 and thereby denied; and WHEREAS, the applicant thereafter appealed to the City Council of the City of Downey, and public notice having been given in the manner provided by law and a hearing held by the City Council on March 22, 1977, and evidence for and against said application having been heard and considered by the City Council; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. City Council finds: (a) That the general plan of the City provides for commercial development of the area in question; (b) That the zoning on the property in question and the adjacent property on both sides is for commercial use; (c) That the general character of the neighborhood frontage on Lakewood is developed and used for commercial uses; (d) That a residential use upon the property in question would be incompatible with the uses on the adjoining properties and the uses generally developed within the area, and that such uses upon the adjoining property and generally within the area are for commercial use and not residential use. SECTION 2. The City Council concludes: (a) That the exception as requested, if granted, would constitute a grant of special privileges inconsistent with the limitations upon other properties and zones in which theproperty is located; (b) That an application of the provisions of the Chapter would not deprive the owner of privileges enjoyed by other properties in the vicinity; (c) That the granting of the exception would be incon- sistent with the purposes and intent of the existing comprehensive zoning plan. - Page 1 - SECTION 3. The decision of the Planning Commission is affirmed, the appeal is denied, the request for the zone exception shall not be granted. SECTION 4.
