A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DENYING AN APPEAL IN ZONE EXCEPTION CASE NO. 1322.
WHEREAS, an application was submitted to the Planning Commission for
a variance to establish, operate and maintain an automobile parking area for
church use and expand the church building to include an educational building in
an R -1 zone in Downey; and
WHEREAS, the Planning Commission at its meeting of January 19, 1977
and February 2, 1977, held public hearings; and
WHEREAS, at the conclusion of said hearing and testimony for and
against said variance was heard and after discussion by members of the Planning
Commission, the Zone Exception was approved by a unanimous vote; and
WHEREAS, a property owner in opposition to the granting of the
variance thereafter appealed to the City Council of the City of Downey, and public
notice having been given in the manner provided by law and a hearing held by the
City Council on March 8, 1977, and evidence for and against said application
having been heard and considered by the City Council:
NOW, THEREAFTER, BE IT RESOLVED AS FOLLOWS:
SECTION 1. City Council finds:
(a) That the use of the subject property as a parking lot
and for future educational building purposes in accordance
with the conditions imposed by the Planning Commission will
not adversely affect the residential character of the
neighborhood.
(b) That there is an existing church use on the property
adjacent to the subject property.
(c) That Downey Avenue is a secondary highway on adopted
Master Plan of Streets and Highways.
(d) That the existing church property is used legally for
parking, school and sanctuary.
(e) That to allow parking and building on the subject
property will decrease the density of use on the existing
property and decrease the impact upon adjoining properties.
(f) That the vehicular use and generation of traffic will
be less than if the subject property were developed for
residential use.
(g) That the proposed use will not be inconsistent with
the general purpose and intent of the General Plan and
Zoning Ordinance.
(h) That the influence of the church as a neighborhood use
is beneficial in that it provides a good environment for
the Community.
(i) That the proposed use will reduce the density of
structural occupancy and provide more open space than
would be permitted by residential development.
SECTION 2. The City Council concludes:
(a) That the exception as requested, if granted, would assure
that the development of an educational building and off - street
parking will be consistent with similar church facilities now
located in R -1 zones. Provisions have been created to protect
adjacent R -1 development from any adverse effect of the church
expansion program.

(b) That strict application of the Zoning Ordinance
would deprive the applicant of uses granted to other
churches in the City of Downey.
(c) That the granting of the exception will not be
inconsistent with the purposes and intent of the
existing Comprehensive Zoning Plan.
(d) That the proposed additional off - street parking
and educational building will not materially change
the character of the surrounding residential neigh-
borhood.
(e) That the proposed expansion of additional off -
street parking and educational building will not have
a detrimental effect upon the public health, safety
or conveneience, nor adversely affect the Comprehensive
Zoning Plan.
(f) The City Council further concludes as hereinabove
found and finds as hereinabove concluded.
SECTION 3. The decision of the Planning Commission is affirmed the
appeal is denied, the request for the zone exceptionshall be granted; provided,
however, the proposed building shall be subject to all applicable ordinances.
SECTION 4. The City Clerk shall certify to the adoption of this
Resolution.
