A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DETERMINING CHANGES IN COMPENSATION AND BENEFITS FOR
SWORN POLICE PERSONNEL FOR 1976 -77
WHEREAS, the City Council recognizes that the City of Downey has an out-
standing Police Department and that every effort should be made to maintain
our quality of service to the citizens of Downey; and
WHEREAS, the City Council also recognizes that taxpayers and legislative
bodies are facing outstanding difficulties in financing public needs, and
accordingly, this City Council must establish compensation and benefit
policies which take into account all factors including fiscal responsibilities
in the maintenance of employee morale and the provision of quality service; and
WHEREAS, this City Council has considered carefully the testimony presented
at the City Council meeting of September 14, 1976, as presented by the Downey
Police Officers Association, the City staff, and the citizens of the community.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the City Council determines that the management's proposal
to the Downey Police Officers Association for 1976 -77, as submitted to the
Association August 23, 1976, constitutes the changes for compensation and bene-
fits which should be provided for the sworn police personnel of the City of
Downey for the year 1976 -77 to the extent hereinafter set forth. The amendments
in the Personnel Manual so as to effect the following changes shall be made.
I. ATTENDANCE AND LEAVES:
A. Sick Leave. Two days of an employee's sick leave may be used on
personal matters which are of an emergency nature and family related.
B. Disability Leave. A disability plan as described in Exhibit "A ".
II. BENEFITS:
A. Employee Medical Benefits.
1. Upgrade the City's insurance plan to $8.00 per unit based on
the 1964 relative value schedule. This would bring the cost
of the City's self - insurance program to be consistent with
Kaiser.
2. Increase the maternity benefit in the City's Health Insurance
Plan to $300.00 for regular birth and $400.00 for caesarean.
3. The City to make available an optional dental and optical plan
to be paid by the employee by January 1, 1977.
B. Uniform Replacement. $180.00 for uniform replacement.
III. COMPENSATION PROGRAM:
A. Increase in gross salary of 5 -1/2% as of July 12, 1976.
B. Three additional holidays paid at 1 -1/2 times the regular rate of
pay.
C. Emergency Service.
In the event of a severe emergency or National or State disaster,
the City shall pay salary only for a period of seven days. No
overtime shall be paid during the aforementioned period.
SECTION 2. In addition to amending the Personnel Manual, the following
matters shall be considered:
ADDITIONAL CONDITIONS.
The parties shall, subsequent to the approval of this resolution,
undertake special meet and confer discussions on the
specific subjects of:
1. A comprehensive Memorandum of Understanding which would include
such items as salary, benefits and other related items.
2. A revised employee relations ordinance.
3. Revisions to City Personnel Rules and Regulations.
The exclusive purpose of such discussion shall be to improve
employee relations consistent with Sections 3500 -3510 of the
Government Code.
Said discussions shall not work in derogation of the rights
of either party.
-l. Definition of Salary.
For comparative purposes, the City and the Association shall
use the employee's retirement gross salary.
SECTION 3. The City Clerk shall certify to the adoption of this
Resolution and cause a copy thereof to be delivered to the appropriate
representatives of the Downey Police Officers Association.

Optional Disability Plan
SECTION 100. Purpose of Plan. The purpose of the Optional
Disability Plan• is to provide each unit employee a fair opportunity and
incentive to earn paid disability leave.
SECTION 200. Plan Eligibility. Any unit permanent employee
(participant) with a minimum accrued sick leave of hours may elect
participation in this Plan as herein provided.
SECTION 300. Plan Periods. Plan periods shall be from July
through June, commencing July 1, 1976.
SECTION 400. Plan Contributions. If an employee has accrued
64 hours sick leave or more during Plan period, a maximum of 25% (1/4)
of such accrued sick leave hours shall upon participant authorization be
transferred annually to an Individual Disability Account (IDA). The
initial IDA contribution of a participant may be a maximum of 25% of 120
or more accrued sick leave hours recorded on the July, 1976 Accrual Report.
The City shall concurrently credit to the same individual account an
amount equal to the number of days authorized for transfer by the partici-
pant. All contributions are irrevocable and non- transferable and shall
not be pooled.
SECTION 500. Plan Benefits. Plan benefits vest upon transfer
to and shall be paid exclusively from the IDA of each participant.
Authorized Plan benefits are payable only as continuation of full salary
to the extent of the total IDA during any period of participant dis-
ability. The participant shall reimburse the City 25% (1/4) of all
benefits paid under this Section.
SECTION 600. Plan Conditions. Participation in this Plan is
subject to the following specific conditions:
a. All Plan benefits paid shall be subject to mandatory
and participant-authorized payroll deductions.
b. The participant shall not be eligible for Employee
Disability Leave or disability retirement unless
and until his or her IDA is exhausted.
c. The IDA of the participant lapses upon employment
separation for whatever reason.
SECTION 700. Plan. Administration and Reports. The City shall
administer this Plan through the Director of Finance who shall:
a. Develop and maintain an appropriate Plan accounting
system.
b. Publish timely information concerning the Plan and
notice of annual enrollment.
c. Provide adequate records and files on Plan partici-
pation.
d. Provide annual IDA statements to each participant.
