HomeMy WebLinkAboutResolution No. 3323 RESOLUTION NO. 3323 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE MEMORANDUM OF UNDERSTANDING WITH THE DOWNEY CITY EMPLOYEES' ASSOCIATION FOR THE FISCAL YEAR 1976 -77 THE CITY COUNCIL OF THE CITY OF DOWNEY RESOLVES AS FOLLOWS: SECTION 1. In accordance with Article II, Chapter 7 of the Downey Municipal Code, the Memorandum of Understanding of July 7, 1976, between the City of Downey and the Downey City Employees' Association, a signed copy of which is attached hereto and made a part hereof, is approved. SECTION 2. All substantive provisions of said memorandum shall be incorporated into City personnel rules and regulations as deemed appropriate by the City Manager, consistent with said memorandum and applicable law. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and shall provide for appropriate distribution thereof. CITY OF DOWNEY ) I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Downey, held on the 27th day of July, 1976, by the following vote, to wit: AYES: 5 Council Members: Greene, Jennings, Miller, Jackman, Scotto NOES: 0 Council Members: None ABSENT: 0 Council Members: None Deputy City Clerk. • • MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF DOWNEY AND DOWNEY FIREMEN'S ASSOCIATION July 12, 1976 After meeting and conferring in good faith, the City Manager and the Downey Firemen's Association agree on the following recommendations to the City Council for 1976 -77. A one -year contract to incorporate the following items: I. Wages 5 -1/4% of gross salary applied to the employee's retirement contribution effective July 12, 1976. I Medical Benefits. 1. Upgrade the City's insurance plan to $8.00 per unit based on the 1964 relative value schedule. This would bring the cost of the • City's self- insurance program to be consistent with Kaiser. 2. Increase the maternity benefit in the City's Health Insurance Plan to $300.00 for regular birth and $400.00 for caesarean. 3. The City to make available an optional dental and optical plan to be paid by the employee by January 1, 1977. III. Special Assignment bonus. .- All personnel assigned to the Fire Prevention and Criminal Investigation Bureau to receive an additional 11% for as long as they are assigned. IV. Additional Conditions. A. The parties shall, subsequent to the execution and approval of this memorandum, undertake special meet and confer discussions on the specific subjects of: • 1. A comprehensive Memorandum of Understanding which would include such items as salary, benefits and other related items. 2. A revised employee relations ordinance. 3. Revisions to City Personnel Rules and Regulations. The exclusive purpose of such discussions shall be to improve employee relations consistent with Sections 3500 -3510 of the Government Code. 4 Said discussions shall not work in derogation of the rights of either party. B. Paramedic Bonus. Paramedics to receive an additional 52% after 18 months of certification and service. C. Sick Leave Accrual Rates. 1. Time earned prior to June 30, 1974 shall be costed at salary rates in effect on June 30, 1974. 2. All earned time accrued on and after July 1, 1974 shall be costed at the rate prevailing at the end of the fiscal year in which it was earned. 3. This section shall be effective as it is effective for the Police Department. D. Emergency Service. In the event of a severe emergency or National or State disaster, the City shall not be required to pay overtime during the first seven days of the severe emergency or disaster. E. Definition of Salary. For comparative purpose, the City and the Association shall include in the definition of "salary" the employee's gross salary and the City's contribution of the employee's portion to the retirement fund referred to as retirement gross salary. F. Effect of Memorandum of Understanding. Changes in benefits are totally included in this Memorandum of Understanding and such are modified as i,.er-0.n stated. °'''''''. The purpose of the Optional Disability Plan is to provide each unit employee a fair opportunity and incentive to earn paid disability leave. SECTION 200. Plan Eligibility. Any unit permanent employee (participant) with a minimum accrued sick leave of hours may elect participation in this Plan as herein provided. SECTION 300. Plan Periods. Plan periods shall be from July through June, commencing July 1, 1976. SECTION 400. Plan Contributions. If an employee has accrued 64 hours sick leave or more during Plan period, a maximum of 25% (1/4) of such accrued sick leave hours shall upon participant authorization be transferred annually to an Individual Disability Account (IDA). The initial IDA contribution of a participant may be a maximum of 25% of 120 or more accrued sick leave hours recorded on the July, 1976 Accrual Report. The City shall concurrently credit to the same individual account an amount equal to the number of days authorized for transfer by the partici- pant. All contributions are irrevocable and non - transferable and shall not be pooled. SECTION 500. Plan Benefits. Plan benefits vest upon transfer to and shall be paid exclusively from the IDA of each participant. Authorized Plan benefits are payable only as continuation of full salary to the extent of the total IDA during any period of participant dis- ability. The participant shall reimburse the City 25% (1/4) of all benefits paid under this Section. SECTION 600. Plan Conditions. Participation in this Plan is subject to the following specific conditions: a. All Plan benefits paid shall be subject to mandatory and participant- authorized payroll deductions. b. The participant shall not be eligible for Employee Disability Leave or disability retirement unless and until his or her IDA is exhausted. c. The IDA of the participant lapses upon employment separation for whatever reason. SECTION 700. Plan Administration and Reports. The City shall administer this Plan through the Director of Finance who shall: a. Develop and maintain an appropriate Plan accounting system. b. Publish timely information concerning the Plan and notice of annual enrollment. c. Provide adequate records and files on Plan partici- pation. d. Provide annual IDA statements to each participant. 7/7/76 MEMORANDUM OF UNDERSTANDING BETWEEN THE DOWNEY CITY EMPLOYEES' ASSOCIATION AND THE CITY OF DOWNEY FOR FISCAL YEAR 1976 -77 After meeting and conferring in good faith, the City Manager and the Downey City Employees' Association agree on the following recommend- ations to the Downey City Council for 1976 -77. A one -year contract, commencing July 1, 1976, to incorporate the following items: Wages, A. Additional 3% of the gross salary applied to employee's contribution to PERS effective July 12, 1976, for a total City contribution of 7 %. B. 2.75% increase in gross salary as of July 12, 1976, as set forth in Table I. C. C. P. I. Adjustment: If the Consumer Price Index for the Long Beach -Los Angeles Area increases by more than 9% during the period July 1, 1976 through June 30, 1977, the Downey City Employees' Association will be able to re -open meeting and conferring for salary only. If the Consumer Price Index for the Long Beach-Los Angeles Area decreases by 3% during the 1976 -77 fiscal year, then the City may re- open for salary purposes only. D. Salary Increase for Part -time Employees: 5 -3/4% effective July 12, 1976 as set forth in Table II. II Medical. A. The establishment of dollar values for the medical- dental- optical benefit package for the employee at the following cost: 1. $28.13 per month for employee only. 2. $56. 26 per month for employee plus one dependent. 3. $79. 92 per month for employee plus two or more dependents. IIL Miscellaneous Increase. Night differential pay of 52 %o for Fire Communications Operators equal to Police Communications Operators effective July 12, 1976. Two days of an employee's sick leave may be used on Y personal matters which are of an emergency nature and family related. Matters of an emergency nature shall be considered as those events or occurrences which a reason- able prudent person would not or could not postpone to a subsequent time. The exact nature of the matter shall be explained to the immediate supervisor and shall be granted with his approval. V. Disability Plan. A disability plan as described in Table III, VL Additional Conditions. A. An understanding that the City is in the process of developing comprehensive Memorandum of Under standing, a new Employee Relations Ordinance and a Personnel Policy Manual. B. For unit employees covered under the City's Social Security program on June 30, 1975, the City shall guarantee disability payment (s) in an amount equal to that which would have been paid under said program. Said employees shall retain such coverage until June 30, 1980. Disability shall be defined as said term is defined for Social Security purposes. C. Sick Leave Accrual Rates. 1. Time earned prior to June 30, 1974 shall be costed at salary rates in effect on June 30, 1974, for retirement. 2. All earned time accrued on and after July 1, 1974 shall be costed at the rate prevailing at the end of the fiscal year in which it was earned, for retirement. D. Definition of Salary. For comparative purposes, the City a.nd the Association shall use the employee's retirement gross salary. E. Emergency Service. In the event of a declared National or State disaster, the City shall, during seven (7) days, pay salary only. (No overtime shall be paid during the aforementioned period. ) Charles W.
