A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONCURRENTLY WITHDRAWING A PORTION OF ZONE I AND
ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON
STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL
JANUARY 31, 1983 (ANNEXATION 76/2 THRU 76/22, 76/24,
76/25 and 76/27)
WHEREAS, the City Council of the City of Downey on April 27, 1976,
adopted Resolution No. 3278, declaring its intention to order certain improvements;
and
WHEREAS, on April 27, 1976, the City Council by Resolution No. 3278
set May 25, 1976, in the Council Chambers of the City Hall of the City of Downey, as
the time and place for hearing protests to the proposed improvements; and
WHEREAS, on May 25, 1976, at the time and place specified, a public
hearing was held in accordance with Resolution No. 3278, notice having been given
in the manner required by law; and
WHEREAS, at the hearing the City Council did pass upon all written and
oral protests made in reference to the improvements:
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. The boundaries of those areas to be annexed to the Downey City
Lighting District are described on Plan Numbers SL 100/51, SL 289, SL 214, SL 100/13,
SL 201, SL 252, SL 291, SL 100/32, SL 272, SL 206, SL 292, SL 294, SL 295, SL 247,
SL 100/49, SL 235, SL 274, SL 265, SL 168, SL 100/50, SL 220 and boundary descriptions
on file in the office of the City Clerk and by this reference made a part hereof.
SECTION 2. The improvement consists of the installation of standards and
furnishing of maintenance and energy for street lighting as described in the Report
of the Director of Community Development dated April 27, 1976, as approved by the
City Council.
SECTION 3. The entire estimated cost of the improvement shall be borne
by the District, and shall be paid by special assessment taxes levied upon all the
lands and improvements within said areas for the period beginning July 1, 1977, and
ending January 31, 1983.
SECTION 4. The improvement described in Resolution No. 3278 and the
Report of the Director of Community Development submitted pursuant to Resolution
No. 3277 shall be made in the manner and at the time prescribed by law.
SECTION 5. The City Council finds that the Southern California Edison
Company subject to the jurisdiction of the Public Utilities Commission of the State
of California, is the only contractor practically capable of serving the street
lighting improvement in the manner provided for and as described herein. It is,
therefore, ordered that the improvement of the Lighting District be carried out
by the Southern California Edison Company in accordance with the plans and
specifications.
SECTION 6. The Mayor is authorized and directed to execute the contract
with the Southern California Edison Company for the improvements in accordance with
- the plans and specifications and in accordance with rates and rules filed by said
Company from time to time with the Public Utilities Commission of the State of
California.
SECTION 7. The City Clerk shall certify to the adoption of this Resolution
and cause a certified copy thereof and the maps or plans of the district to be filed
with the assessor whose roll is used for the levy and with the State Board of
Equalization and further shall cause a copy of this resolution to be published once
in the Southeast News and Downey Champion.

SECTION 8. Inasmuch as the property assigned Annexation 76 Area 10,
commonly known as 8601 Florence Avenue has recently redeveloped from
residential to commercial property, this property shall be withdrawn from the
residential Zone I and concurrently annexed into the commercial Zone II of the
Downey City Lighting District.
SECTION 9. The City Clerk shall certify to the adoption of this
Resolution.
