A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONCURRENTLY WITHDRAWING A PORTION OF ZONE I AND
DECLARING ITS INTENTION TO ANNEX CERTAIN AREAS TO THE
DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND
FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES
ON THE STREETS AND PUBLIC PLACES WITHIN THOSE AREAS
UNTIL JANUARY 31, 1983. (ANNEXATION 76/2 THROUGH 76/27)
THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the public interest and convenience require, and
it is the intention of the City Council of the City of Downey to order
the annexation of certain areas to the Downey City Lighting District,
and to maintain and furnish electrical current to street lighting
fixtures as shown on Plan Nos. SL 100 /51, SL 289, SL 214, SL 100/13,
SL 201, SL 252, SL 291, SL 100 /32, SL 272, SL 206, SL 292, SL 294,
SL 295, SL 247, SL 100 /49, SL 235, SL 274, SL 265, SL 179, SL 100/50,
SL 220, SL 168, on file in the office of the City Clerk from the date
of formation of the district until January 31, 1983, in accordance
with the Report of the Director of Community Development dated
April 27, 1976, on file in the office of the City Clerk and which
by this reference is made a part hereof.
SECTION 2. These annexations, in the opinion of the City Council,
are of more than ordinary benefit and the Council hereby makes the
expense of said work and improvements chargeable upon the district
benefitted and to be assessed to pay the cost and expense thereof.
The district is that portion of the City of Downey shown on the above
specified plans on file in the office of the City Clerk, on which
the boundaries thereof are described by a boundary line. Reference
is hereby made to the plans for a complete and detailed description
of the district. The plans on file shall govern for all details as
to the extent of the assessment district.
SECTION 3. Any lots or parcels of land known as public property,
as defined in Section 18014 of the California Streets and Highways
Code ( "Street Lighting Act of 1919 "), which are included in the
assessment district shall be exempt from assessment made to cover
costs and expenses of the contemplated improvements.
SECTION 4. The improvements contemplated shall be done under the
provisions of the "Street Lighting Act of 1919 ", Part I of Division 14
of the California Streets and Highways Code (as amended), under the
alternative procedure for ad valorem assessments provided for in
Chapter 8.5 of the "Street Lighting Act of 1919 ".
SECTION 5. Pursuant to the provisions of Section 18070 of
the Streets and Highways Code, the City Council of the City of Downey
hereby sets May 25, 1976, at 8 o'clock a.m. in the Council Chambers
in the City Hall of said City as the time and place for hearing
protests to the proposed annexations.
SECTION 6. The City Clerk shall give notice of this hearing in
the manner provided in the "Street Lighting Act of 1919 ". The
publication of such notice shall be in the "Southeast News and Downey
Champion ", a newspaper published and circulated in the City and
hereby designated by said City Council for purpose of publication.
SECTION 7. The Director of Community Development of the City of
Downey shall cause to be conspicuously posted along all streets in
the district where the improvement is proposed to be made or which is
to be assessed for the benefits thereof, at not more than 300 feet
apart but not less than 3 in all, notices of the passage of the
resolution as required by Section 18071 of the Streets and Highways
Code.
SECTION 8. Inasmuch as the property assigned Annexation 76
Area 10, commonly known as 8601 Florence Avenue, has recently
redeveloped from residential to commercial property, it is hereby the
intention of the City Council to withdraw this property from the
residential Zone I and annex the property into the commercial Zone II
of the Downey City Lighting District.
SECTION 9. The City Clerk shall certify to the adoption of
this resolution.
