A RESOLUTION OF TILE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING THAT AN UNDERGROUNI) UTILITY DISTRICT BE FORMED
YURSUANT TO RESOLUTION NO. 3255 (DISTRICT NO. 6 -
IRESTONE BOULE:YARD)
WHFa.FAS, pursuant. to Resolution No . 3255 a public hearing was held
on Aprili I2, 1976, by she City Council of the City of Downey; and
'WHEREAS, notice of such hearing was given in the manner required
by law; and
WHEREAS, such hearing has been duly held, and all persons interested
were given an opportunity to be heard.
NOW THEREFORE , THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. Teat it hereby finds and determines that the public
necessity, safety, and welfare require the. removal of poles, overhead •
wires, and associated structures and the underground installation
of wires and facil-Lities for supplying electrical, communications, or
similar or associated service in the City of Downey along Firestone
Boulevard and Woodruff Avenue; major arterial highways extensively
used b the generai. public; and carrying a heavy volume of vehicular
traffic from west Jf Brookshire Avenue to Woodruff Avenue and 0
Wood;tff Avenue north of Firestone Boulevard, as shown on Plan No.
3 -2 -47. The area within Underground Utility District No. 6 is further
described by boundary description filed in the Office of the City
Clerk along with Plan No. 3 -2 -47 both of which by this reference
are made a part hereof.
SECTION 2. Those poles, overhead wires, and associated overhead
structures on Firestone Boulevard and Woodruff Avenue from west of
Brookshire Avenue to Woodruff Avenue and Woodruff Avenue north of
Firestone Boulevard, as shown on Plan No. 3 -2-47, shall be removed
and underground installations made in said Underground Utility
District not late: than November 30, 1977, provided, however, utility j
companies upon a showing that they cannot comply with such limitations
may, upon approval of the City Council, have an extension of time as
provided in SectixT 7510 of the Downey Municipal Code. In order to
provic:► adequate time for the utility companies to convert their
overhead service connections to private properties not voluntarily
converted, all pri'tate property improvements required by this district
to be installed by the property owner shall be completed not later
than June 30, 1977. •
SECTION 3. 'Within ten (10) days after the adoption of this
Resolution, the City shall mail a copy of the same and a copy of
Chapte-c 5, Article VII, of the Downey Municipal Code to affected
property owners as such are shown on the last equalized assessment
roll and to the affected utilities.
SECTION 4. The City Clerk shall certify to the adoption of this
Resolution.
