A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DEC RING ITS INTENTION TO ANNEX A CERTAIN AREA TO THE
DaEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH
EISCTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE
Z.EETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL
NUARY 31, 1983. (ANNEXATION 76/1 - FIRESTONE BOULEVARD)
THE L.TY COUNCIL OF THE CITY OF DOWNEY.HEREBY RESOLVES AS FOLLOWS:
SEC°ION 1. That the public interest and convenience require, and
it is the intention of the City Council of the City of Downey to order
the annexation of a certain area to the Downey City Lighting District,
and to maintain and furnish electrical current to street lighting
fixtures located on portions of Firestone Boulevard, Lakewood Boulevard,
and Woodruff Avenue as shown on Plan No. SL -282 on file in the office
of the City Clerk, from the date of formation of the district until
January 31, 1983, in accordance with the Report of the Director of
Community Development dated March 23, 1976, on file in the office of
the City Clerk and which by this reference is made a part hereof.
SECTION 2. This annexation, in the opinion of the City Council,
is of more than ordinary benefit and the Council hereby makes the
operations expense of said work and improvements chargeable upon the
district benefitted and to be assessed to pay the cost and expense
thereof. The district is that portion of the City of Downey shown on
the above specified plan on file in the office of the City Clerk, on
which the boundaries thereof are described by a boundary line.
Reference is hereby made to the plan for a complete and detailed
description of the district. The plan on file shall govern for all
details as to the extent of the assessment district.
ECTION 3. Any lots or parcels of land known as public property,
as der-- -fined in Section 18014 of the California Streets and Highways Code
( "Street Lighting Act of 1919 "), which are included in the assessment
district shall be exempt from assessment made to cover costs and expenses
of the= contemplated improvements. Such assessments shall be borne by
the D'^istrict.
CTION 4. The improvements contemplated shall be done under the
provisions of the "Street Lighting Act of 1919 ", Part I of Division 14
of the California Streets and Highways Code (as amended), under the
alterative procedure for ad valorem assessments provided for in
Chapter 8.5 of the "Street Lighting Act of 1919 ".
CTION 5. Pursuant to the provisions of Section 18070 of the
Streeti and Highways Code, the City Council of the City of Downey hereby
sets )gril 12, 1976, at 7 :30 o'clock p.m., in the Council Chambers in the
City H411 of said City as the time and place for hearing protests to the
proposed annexation.
SIC TION 6. The City Clerk shall give notice of this hearing in
the man provided in the "Street Lighting Act of 1919 ". The publication
of such notice shall be in the "Southeast News and Downey Champion ",
a newspaper published and circulated in the City and hereby designated by
said City Council for purpose of publication.
SEC TON 7. The Director of Community Development of the City of
Downey shall cause to be conspicuously posted along all streets in the
district .mere the improvement is proposed to be made or which is to
be assessed for the benefits thereof, at not more than 300 feet apart
but not less than 3 in all, notices of the passage of the resolution as
required by Section 18071 of the Streets and Highways Code.
_ SECTION 8. In as much as the assessment for the property
commonly known as the "STONEWOOD SHOPPING CENTER," would be excessive
for operations costs in Zone II ofthe Downey City Lighting District,
a new zone with a rate reflecting the actual costs for operation
of to lights adjacent to this property shall be created. This
proposed zone would be identified as Zone V of the Downey City
LiI Ling District.
SECTION 9. The City Clerk shall certify to the adoption of this
. esolution.
