HomeMy WebLinkAboutResolution No. 3196 RESOLUTION NO. 3196 A RESOLUTION OF THE CITY COUNCIL OF THE CITY CF DOWNEY ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATIONS 75/22 THROUGH 75/24, 75/27 and 75/29 THROUGH 75/35) WHEREAS, the City Council of the City of Downey on October 28, 1975, adopted Resolution No. 3185, declaring its intention to order certain improvements; and WHEREAS, on October 28, 1975, the City Council by Resolution No. 3185 set 8 a.m., November 25, 1975, in the Council Chambers of the City Hall of the City of Downey, as the time and place for hearing protests to the proposed improvements; and WHEREAS, on November 25, 1975, at the time and place specified, a public hearing was held in accordance with Resolution No. 3185, notice having been given in the manner required by law; and WHEREAS, at the hearing the City Council did pass upon all written and oral protests made in reference to the improvements: NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of those areas to be annexed to the Downey City Lighting District are described on Plan Numbers SL- 100/60, SL -221, SL -288, SL -227, SL- 100/55, SL -287, SL -244, SL -44, SL- 100/26, SL- 100/57 and boundary descriptions on file in the office of the City Clerk and by this reference made a part hereof. SECTION 2. The improvement consists of the installation of standards and furnishing of maintenance and energy for street lighting as described in the Report of the Director of Community Development dated October 28, 1975, as approved by the City Council. SECTION 3. The entire estimated cost of the improvement shall be borne by the District, and shall be paid by special assessment taxes levied upon all the lands and improvements within said areas for the period beginning July 1, 1976, and ending January 31, 1983. SECTION 4. The improvement described in Resolution No. 3185 and the Report of the Director of Community Development submitted pursuant to Resolution No. 3184 shall be made in the manner and at the time prescribed by law. SECTION 5. The City Council finds that the Southern California Edison Company subject to the jurisdiction of the Public Utilities Commission of the State of California, is the only contractor practically capable of serving the street lighting improvement in the manner provided for and as described herein. It is, therefore, ordered that the improvement of the Lighting District be carried out by the Southern California Edison Company in accordance with the plans and specifications. SECTION 6. The Mayor is authorized and directed to execute the contract with the Southern California Edison Company for the improvements in accordance with the plans and specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution and cause a certified copy thereof and the map or plan of the district to be filed with the assessor whose roll is used for the levy and with the State Board of Equalization and further shall cause a copy of this resolution to be published once in the Southeast News and Downey Champion. SECTION 8. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 25th day of November , 19 75 . \� \___' Jose' Es.
