A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF A CERTAIN AREA TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON
STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL
JANUARY 31, 1983 (ANNEXATION 75/26 FIFTH STREET)
WHEREAS, the City Council of the City of Downey on July 22, 1975,
adopted Resolution No. 3153, declaring its intention to order certain
improvements; and
WHEREAS, on July 22, 1975, the City Council by Resolution No. 3153
set August 11, 1975, in the Council Chambers of the City Hall of the City
of Downey, as the time and place for hearing protests to the proposed
improvements; and
WHEREAS, on August 11, 1975, at the time and place specified, a
public hearing was held in accordance with Resolution No. 3153, notice
having been given in the manner required by law; and
WHEREAS, at the hearing the City Council did pass upon all written
and oral protests made in reference to the improvements:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The boundaries of that area to be annexed to the Downey
City Lighting District are described on Plan Number 3- 2 -46 /SL on file in
the office of the City Clerk and by this reference made a part hereof.
.m. SECTION 2. The improvement consists of the installation of standards
and furnishing of maintenance and energy for street lighting as described
in the Report of the Director of Community Development dated July 22, 1975,
as approved by the City Council.
SECTION 3. The entire estimated cost of the improvement shall be
borne by the District, and shall be paid by special assessment taxes
levied upon all the lands and improvements within said area for the period
beginning July 1, 1976, and ending January 31, 1983.
SECTION 4. The improvement described in Resolution No. 3153 and
the report of the Director of Community Development submitted pursuant to
Resolution No. 3152 shall be made in the manner and at the time prescribed
by law.
SECTION 5. The City Council finds that the Southern California Edison
Company subject to the jurisdiction of the Public Utilities Commission of
the State of California, is the only contractor practically capable of
serving the street lighting improvement in the manner provided for and as
described herein. It is, therefore, ordered that the improvement of the
Lighting District be carried out by the Southern California Edison Company
in accordance with the plans and specifications.
SECTION 6. The Mayor is authorized and directed to execute the
contract with the Southern California Edison Company for the improvements
in accordance with the plans and specifications and in accordance with
rates and rules filed by said Company from time to time with the Public
Utilities Commission of the State of California.
SECTION 7. The City Clerk shall certify to the adoption of this
Resolution and cause a certified copy thereof and the map or plan of the
district to be filed with the assessor whose roll is used for the levy
and with the State Board of Equalization and further shall cause a copy of
this resolution to be published once in the Southeast News and Downey
Champion.
SECTION 8. The City Clerk shall certify to the adoption of this
Resolution.
