A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING MISCELLANEOUS EMPLOYEE ADJUSTMENTS EFFECTIVE
7/7/75
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City of Downey Personnel Manual be and the same
is hereby amended as set forth below, effective July 7, 1975.
1.1 Table I on pp. 78 -79 is amended to read as shown in Attachment
A -1, effectuating a 5.5% increase in the dollar values of each pay
schedule and half schedule.
1.2 The following Note I is added at the end of Table I on pp. 78 -79:
Note 1: If the United States Consumer Price Index for all
items for the Los Angeles -Long Beach area (1967 =100 series)
measured from July, 1975, increases by 3.0% prior to July 1,
1976, over and above the 5.5% increase provided for in Sec-
tion 1.1 hereof, miscellaneous employees will receive a 3.0%
compensation increase as deferred compensation toward the
employee's contribution to the retirement system. This com-
pensation increase shall be effective as of the first day of
the first payroll period following receipt of proof of such
Consumer Price Index increase by the City Manager. If said
index decreases by 3.0% prior to July 1, 1976, miscellaneous
employees will receive a 3.O7 reduction in salary. This de-
crease shall be effective as of the first day of the first
payroll period following receipt of proof of said Index by
the City Manager.
1.3 Amend Section 3 on p. 2 to read as follows:
SECTION 3: "Anniversary Date ". The adjusted date of an
employee's appointment, from which salary step increases,
sick leave, vacation, seniority, probation, and other
benefits are computed.
For all purposes, the anniversary date of all sworn employees
shall be the first day of the month following the month in
which they were employeed in their present respective classes
where appointment is made after the first working day of the
month. For all purposes for miscellaneous employees all
benefits shall be calculated beginning in the month in which
the employee is hired. Such benefits being calculated
beginning at the payroll period following the hiring date,
but in no case shall the benefits be apportioned in a fraction
of less than one -half day.
1.4 The benefit schedule under the City's Medical and Hospital Plan
(Attachment A -2) is hereby made part of the Personnel Manual
and shall be inserted as p 63 -1.
The present $4,000 face value group life term insurance for
miscellaneous employees is hereby increased to $5,000.
1.5 Add new Section 2 A on p 63 as follows:
2 A. Retired miscellaneous employees may participate in the
plan by paying their equivalent full premium cost as
determined by the Director of Finance and as provided
in Section 2 C.
1.6 Add new Section 2 C on p 63 as follows:
2 C. Medical Benefit Compensation: Upon retirement of a
miscellaneous employee and at his request the City shall
apply his unused sick leave to pay full premium for his
City health insurance coverage on the following basis:
1) 40/0 of the days accumulated shall be deducted first,
starting with the oldest days earned, then the remaining
60% will be applied.
2) The employee may elect to be paid for such remaining 60%
accumulated time as follows:
a) Time earned prior to June 30, 1974, shall be costed at
salary rates in effect on June 30, 1974.
b) All earned time accumulated in and after July 1, 1974
shall be costed at the rate prevailing at the end of
the fiscal year in which it was earned.
3) If the employee dies before using this allowance, the balance
shall be paid to his estate.
4) Employees may not elect to take part payment immediately on
retirement and apply part to insurance coverage.
1.7 Amend Section 5 on pp. 57 - 58 to reflect that the Miscellaneous
employees shall receive December 24 as a holidy and rescind the
one -half day before Christmas or New Year's Day and State -wide
election days.
1.8 Amend Table I C on p 82 -84 by adding a new category at the end
thereof to be known as "Middle Management" and to read as set
forth below:

Note 1. The Downey City Employees Association may represent the
above "Middle Management" employees for the purposes of meeting and
conferring relative to salaries and benefits only, during such time
as said association is recognized as their "appropriate unit" as
provided in Sec. 2756 DMC.
1.9 Add new Section 8 C 4) on p 60 to read as follows:
4. A Miscellaneous employee who has become entitled to
accrued sick leave allowance which has not been used, may
convert each two and one quarter days (24) of accumulated
sick leave to one (1) additional day of vacation, after
having accumulated eighty (80) days of sick leave and
providing that not more than five (5) days of additional
vacation days may be so converted in any one fiscal year.
1.10 Amend Section 4A on p 64 by increasing the non -sworn fire and
police uniform allowance from $90 to $125 per year.
1.11 Amend Section 7 C on p 59 by inserting the word "sworn" as the
third word in the first paragraph thereof; and by adding a new
Section 7 C la immediately following the present vacation
schedule in Section 7 C 1 to read as follows:

a. All eligible miscellaneous employees shall accrue
vacation leave in accordance with the following schedule:

4 - 5 12
6 - 10 15
11 - 15 17
16 - 20 20
Two years maximum accumulation.
SECTION 2. That the City will apply for implementation to the Public
Employees Retirement System contract option providing for the use of one
final compensation (last year of employment unless allowance designated)
as retirement allowance base for miscellaneous employees (CH 195 - SB 1506),
provided it does not cost over 1% of total miscellaneous payroll per year.
SECTION 3. That the City will inform the President of the Downey City
Employees' Association, monthly, of all new hires and terminations of
employees eligible for representation by said association as "appropriate
unit" as provided in Section 2756 DMC.
SECTION 4. That only cities in Los Angeles and Orange counties be-
tween 75,000 and 130,000 in population (according to Controller's Annual
Report of Financial Transactions "Estimated Population ") which provide
essentially the same services as Downey will be surveyed to estimate
prevailing patterns of comparable salaries and benefits for miscellaneous
employees. The latest Controller's Report lists these cities as:

This list will be used during 1975 -76 for miscellaneous classifications.
SECTION 5. For any employee as of the date of this Resolution not
otherwise covered for disability, the City shall guarantee payment to said
employee an amount equal to the payment he would have received under Social
Security for less than 5 years service. Disability shall be defined as
said term is defined for Social Security purposes.
SECTION 6. The City Clerk shall certify to the adoption of this
Resolution and shall provide for appropriate distribution thereof.
