HomeMy WebLinkAboutResolution No. 3099 RESOLUTION NO. 3099 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXPRESSING OPPOSITION TO THE PROPOSED BROWN ACT, SENATE BILL 175 (MARKS) i WHEREAS, the City Council of the City of Downey recognizes the purpose of the RALPH M.BROWN ACT; and WHEREAS, the City Council of the City of Downey holds regular meetings at least twice each month; and WHEREAS, the City Clerk of the City of Downey publishes a City Council Meeting Agenda as of the close of business on the Thursday pre- ceding each regular meeting of the City Council of the City of Downey; and WHEREAS, "non- emergency condition" items not included on a City Council Meeting Agenda on occasion have been and will be submitted for consideration at City Council Meetings; and WHEREAS, SB 175 would subject local City Council committees and subcommittees, whether or not constituting a full quorum, to the provisions of the Brown Act; and WHEREAS, SB 175 would make it a misdeameanor for a Council- man to attend a meeting later construed to be in violation of the Brown Act, even though such attendance was without knowledge of violation; and WHEREAS, similar amendments proposed to the Brown Act in the past have been rejected by the Legislature as unnecessary and un.. I workable. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That this City Council opposes the Senate Bill 175 BROWN ACT proposed requiring the legislative body of any local agency subject to the RALPH M. BROWN ACT to give mailed notice to any person who has filed a written request and that such notice include the items of business to be transacted. SECTION 2. The City Clerk shall distribute copies of this Resolution to the Senate Committee on Local Government (Marks - Chairman) and to the League of California Cities. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 25th day of March, 1975. r , Josep E.
