HomeMy WebLinkAboutResolution No. 3093 RESOLUTION NO. 3093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ESTABLISH AN UNDERGROUND UTILITY DISTRICT WITHIN THE THREE BLOCK AREA BOUNDED ON THE NORTH BY THIRD STREET, ON THE SOUTH BY SECOND STREET AND FIRESTONE BOULEVARD, ON THE WEST BY DOWNEY AVENUE AND DOLAN AVENUE AND ON THE EAST BY BROOKSHIRE AVENUE, AS SHOWN ON PLAN NO. 3 -2 -45, AND CAUSING ALL SPECIFIED UTILITIES THEREIN TO BE RELOCATED UNDERGROUND (DISTRICT NO. 8) THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the public interest and convenience require, and that it is the intention of the City Council of the City of Downey to establish an Underground Utility District and to order the removal of poles with their related overhead wires and assorted overhead structures within the three block area bounded on the north by Third Street, on the south by Second Street and Firestone Boulevard, on the west by Downey Avenue and Dolan Avenue and on the east by Brookshire Avenue, all in accordance with the provisions of Chapter 5, Article VII of the City of Downey Municipal Code. SECTION 2. The Underground Utility District boundary shall be as shown on Plan No. 3 -2 -45 on file in the office of the City Clerk. A description of the area is also on file in the Office of the City Clerk. By this reference, both the plan and the description are made parts hereof. SECTION 3. All Work contemplated by the Resolution of Intention shall be done in accordance with the provisions of Chapter 5, containing Sections 7500 through 7510 of Article VII, of the City of Downey Municipal Code. All improvements shall be completed by November 1, 1975, and the cost thereof shall be paid for by the Utility Companies and properties benefited. SECTION 4. Pursuant to the provisions of Section 7501 of the City of Downey Municipal Code, the City Council of the City of Downey hereby sets the hour of 7:30 p.m., April 14, 1975, as the time and the Council Chambers at the City Hall of the City of Downey as the place for the hearing of protests in relation to the proposed District. SECTION 5. The City Clerk shall give notice of said hearing in the manner provided in Section 7501 of the City of Downey Municipal Code. APPROVED AND ADOPTED this 10th day of March , 1975.
