• . A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY, CALIFORNIA,
• 'OPPOSING PROPOSED REGULATIONS UNDER
TITLES 9, 17, AND 22 OF THE CALIFORNIA
ADMINISTRATIVE CODE, RELATING TO THE
LICENSING AND CERTIFICATION OF
COMMUNITY CARE FACILITIES.
WHEREAS, the State Department of Health pursuant to authority
vested by Sections 208, 1523, 1530, and 1531 of the Health and Safety Code'
4.. and by Sections 16118 and 16309 of the Welfare and Institutions Code, and
to implement, interpret or make specific Sections 1501, 1502, 1503, 1504,
1505, 1506, 1507, 1508, 1509, 1520, 1522, 1523, 1524, 1525, 1526, 1530, 1531,
1533, 1534, 1538, 1539, 1550, 1553, 1554,1560, 1561 and 1562 of the Health
and Safety Code and Sections 16100, 16118, 16300, 16300.1, 16301, 16302,
16303, 16304, 16304.1,16305, 16306,16307, 16308, 16309, 16310, 16311, 16312,
16313, 16314, 16315, and 16317, of the Welfare and Institutions Code, has
. proposed to adopt or repeal certain regulations in Titles 9, 17 and 22 of the
California Administrative Code, in order to implement and comply with the
. provisions of Assembly Bill 2262 entitled "California Community Care Facilities
Act, which became 'operative January 1st, 1974;'and
WHEREAS, the.proposed regulations would require that community
pre - school and day care operations pay annual-licensing fees of $250.00 plus'
80 cents per child enrolled, hire an occupational therapist as well as a
dietition, and reduce the ratio of teachers to children from the present
1 to 12 to the ratio of 1 to 6. Most pre - school and day care centers provide
a needed community service at nominal cost; the proposed regulations would
financially price most of them out of existence.
WHEREAS, in addition to pre- school and day care programs,
regulations to AB2262 may increase expenses for any agency which may be
termed a "community care facility," such as drug and alcoholic abuse pro -
jects, rehabilitation centers, and community mental health agencies. The
increased expenses iu the form of permit fees, staffing requirements,
reporting procedures, and code compliance would make it very difficult for •
many agencies to function.
WHEREAS, these detailed regulations may very well limit future
City attempts to develop municipal solutions to community problems, as
proposed by the League of California Cities.
WHEREAS, the regulations may have a significant dampening
the flexibility and innovation of community -based programs which
effect on
have e traditionally filled service gaps left by piece -meal higher governmental
efforts to solve social problems.
WHEREAS, the City Council of the City of Downey, has carefully
studied the proposed new regulations.
• NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA.
DOES RESOLVE AS FOLLOWS:
sq. 0 SECTION 1. That the City Council of the City of Downey, does
hereby oppose the adoption of the proposed regulations for the reasons set
forth above.
SECTION 2. That the City shall certify to the adoption of
this resolution and forward copies of the same to our State legislators; to
the Director, State Department of Health, 714 PStreet, Sacramento, California
95814• the State Secretary of Health and Welfare, 915 Capitol Mall, Room 200,
Sacramento, California 95814; and the League of California Cities, 702 Hilton
Center, Los Angeles, California 90017.
