A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR CHAPTER 27 PROCEEDINGS
FOR DOWNEY IMPROVEMENT PROJECT NO. 643 A & B, EAST AND
WEST SIDE OF SUSAN AVENUE, NORTH OF VIA AMORITA
WHEREAS, the City Engineer has submitted Engineer's Report No. 643 A & B,
setting forth the cost of doing certain work under and pursuant to Chapter 27
of Part 3, Division 7 of the Streets and Highways Code of the State of
California; and
WHEREAS, notices of the hearing of the confirmation of the assessment
have been duly posted and mailed; and
WHEREAS, the Council has heard all protests for and against the assessment
in accordance with the Engineer's Report above stated.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That protests to the doing of the work or assessment of any
of the costs in Engineer's Report No. 643 A & B hereby are overruled.
SECTION 2. The cost of construction as assessed by Engineer's Report
No. 643 A & B hereby is confirmed, and if not paid within five days after this date
of confirmation, the cost set forth in said report shall constitute a special
assessment against the parcel of property described, and shall be a lien
thereon, all in accordance with Section 5890 of the Streets and Highways Code
of the State of California.
SECTION 3. That payment of such assessments less than $150.00 shall be
made in one installment and assessments of $150.00 to $600.00 shall be made
in 3 annual installments, and payments of assessments of $600.00 or more
shall be made in 10 annual installments, all in the manner provided in Section
5895 of said Code.
SECTION 4. The aforesaid assessment shall bear interest on the unpaid
balance at a rate of 7% per annum, said interest to begin on the 31st day
after the confirmation of the assessment.
SECTION 5. The City Clerk shall certify to the adoption of this resolution,
and thenceforth and thereafter the same shall be in full force and effect.
